EX PARTE PRESENTATIONS IN UNITED ARTISTS CABLE OF BALTIMORE CABLE RATE PROCEEDING June 21 , 1995 In United Artists Cable of Baltimore, DA 95-737 (Cab. Serv. Bur., released April 6, 1995), the Cable Services Bureau acted on an appeal filed by United Artists Cable of Baltimore ("United Artists") of a cable rate order adopted by the City of Baltimore, Maryland. Although appeals of local rate decisions filed with the Commission are generally treated as "restricted" proceedings for ex parte purposes, see Third Order on Reconsideration (MM Docket Nos. 92- 266 & 92-262), 9 FCC Rcd 4316 (1994), the Cable Services Bureau issued a public notice, pursuant to Section 1.1200(a) of the Commission's Rules, 47 C.F.R. 1.1200(a) on June 19, 1995, that changed the ex parte status of the United Artists rate order appeal proceeding from "restricted" to "non-restricted." The Bureau stated that making this appeal a non-restricted proceeding under Section 1.1206 of the Rules, 47 C.F.R. 1.1206, would permit a broader range of views and participation on a matter that could have a signficant impact on a large number of persons who have not previously participated as parties to this proceeding. See Public Notice "Commission Applies 'Permit But Disclose' Ex Parte Rules to Reconsideration of United Artists Cable of Baltimore ," DA 95-1366 (Cab. Serv. Bur., released June 19, 1995). Prior to the release of this public notice, ex parte presentations were made from a number of individuals or organizations. Because the issue in the rate appeal proceeding is a matter of widespread interest and of significant impact beyond the immediate parties to the proceeding and in view of the fact that the change in ex parte status of this proceeding now permits ex parte presentations in accordance with the procedures in Section 1.1206(a), we have concluded that the public interest would be served by consideration of these presentations in the record of the proceeding. Also included in the record of the proceeding are an April 7, 1995 memorandum and an April 20, 1995 letter from the National Association of Telecommunications Officers and Advisors. It appears that any impermissible presentations were inadvertent. Accordingly, pursuant to Section 1.1212(d) & (f) of the Commission's Rules, 47 C.F.R. 1.1212(d) & (f), the Managing Director is hereby providing notice and disclosure to the parties to this proceeding of these ex parte presentations through release of this public notice. Copies of the written ex parte presentations shall be placed in the record of the proceeding.
