CSB-A-0657 ORDER Adopted: July 13, 2001 Released: July 18, 2001 By the Chief, Consumer Protection and Competition Division, Cable Services Bureau: 1. On June 28, 2001, TCI Cablevision of Dallas, Inc. ("TCI-D") and the City of Dallas, Texas ("City") filed with the Commission a joint motion to withdraw an appeal of local rate order filed by TCI-D on June 23, 2000. TCI-D had filed an appeal and a emergency stay request of a local order adopted by the City. 2. In its motion, TCI-D states it has now reached an acceptable resolution of this matter with the City. TCI-D and the City therefore seeks to withdraw the appeal and related filings pending before the Commission and to terminate the bond associated with FCC Stay Order DA 00-1240. The parties together request that the appeal, as well as all subsequent filings related to these proceedings be withdrawn and dismissed with prejudice and without benefit of substantive Commission review. This withdrawal resolves all pending rate matters involving TCI-D and the City. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeal of Local Rate Order filed by TCI Cablevision of Dallas, Inc. and the City of Dallas, Texas IS GRANTED, the appeal filed by TCI-D on June 23, 2000 IS DISMISSED and the bond IS TERMINATED. 4.
