By the Chief, Consumer Protection and Competition Division, Cable Services Bureau:

1.     On February 6, 2001, Heritage Cablevision, Inc. d/b/a TCI of Central Iowa ("TCI-CI") and
the City of Des Moines, Iowa ("City") jointly moved to terminate Commission review of local rate orders
currently pending before the Commission.  This withdrawal resolves all pending BST rate matter
involving TCI-CI and the City.  Accordingly, TCI-CI and the City request that the appeals, petition for
reconsideration, emergency stay requests, as well as all subsequent filings related to these proceedings be
withdrawn and dismissed with prejudice and without benefit of substantive Commission review.
2.     Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeals of Local Rate
Orders filed by Heritage Cablevision, Inc. d/b/a TCI of Central Iowa and the City of Des Moines, Iowa
IS GRANTED and the appeals, petition for reconsideration and stay requests ARE DISMISSED.
3.     This action is taken pursuant to authority delegated by Section 0.321 of the Commission's
rules.  47 C.F.R.  0.321.
