By the Chief, Consumer Protection and Competition Division, Cable Services Bureau:

1.     On January 29, 2001, Heritage Cablevision, Inc. d/b/a TCI of Central Iowa ("TCI-CI") filed
with the Commission a motion to withdraw an appeal of a local rate order adopted by the City of Des
Moines, IA concerning regulation of TCI-CI's local commercial rates.  TCI-CI states that it has now
reached an acceptable resolution of this matter with the City.  Accordingly, TCI-CI requests that the
appeal, emergency stay request, and all filings related to this proceeding be withdrawn and dismissed
with prejudice and without benefit of substantive Commission review.
2.     Accordingly, IT IS ORDERED that the Motion to Withdraw Appeal of Local Rate Order
filed by Heritage Cablevision, Inc. d/b/a TCI of Central Iowa IS GRANTED and the appeal and stay
request ARE DISMISSED.
3.     This action is taken pursuant to authority delegated by Section 0.321 of the Commission's
rules.  47 C.F.R.  0.321.
