On June 9, 1997, Falcon Cablevision, a California Limited Partnership ("Falcon"), filed with the Commission a petition for review of a local rate order adopted by the City of Calabasas, California ("City") on April 16, 1997. In its rate order, the City established new regulated rates for basic service and required Falcon to refund overcharges to subscribers. 2. On September 3, 1999, Falcon filed a Motion to Withdraw its Petition for Review. In its motion, Falcon states that in connection with the sale of the System and the transfer of its franchise for the City to Charter Communications, Inc. it has agreed to withdraw the Petition. No opposition to the motion has been filed. Therefore, Falcon's motion to withdraw is accepted. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Petition for Review filed by Falcon IS GRANTED and the Petition for Review IS DISMISSED. 4.
