criticism concerning the lack of  xprogramming in this area by showing in its reply that the Station carries six programs, which WVBX  S' xargues, are "specifically targeted to children" and run for a total of three hours weekly.Q  {O'ԍReply at 2, See footnote 22, above.Q Pursuant to  S' xSection 73.671 of the Commission's rules, television licensees, including LPTVs,C yO!'ԍ47 C.F.R.  76.55(d)(2).C are required to  S' x*broadcast some programming that serves "the educational and informational needs of children,"WX,  yOl#' xZ ԍ47 C.F.R.  73.671. Educational and informational television programming is any television programming  x that furthers the positive development of children 16 year of age and under in any respect, including the child's cognitive/intellectual or emotional/social needs.W but the"L ,p(p(88"  xCommission does not substitute its judgment in the place of broadcasters to determine how they should  S'provide such programming. S' e  12.` ` Concerning the issue of local news and informational programming required by Section  S`' x&76.55(d)(2) of the Commission's rules,C!` yO 'ԍ47 C.F.R.  76.55(d)(2).C WVBX has not proffered any evidence that its programming  xaddresses important news and local informational needs of the communities Time Warner serves. The  S' x7instant case can be distinguished from Lankenau. In that case, the station in question "provided program  xIlogs that detail[ed] the specific types of local information that it provide[d] its viewers." Thus, the  S' xCommission found that "the station ha[d] made a prima facie case that it addresse[d] local news and  S' xinformational" requirements.<"B yO~'ԍ12 FCC Rcd at 17485.< Here, we only have unsupported allegations by WVBX that its  xprogramming meets local needs not addressed by the area's full power stations. Moreover, we disagree  xwith WVBX's contention that Time Warner had the burden of rebutting WVBX's assertions that the  S$ ' xStation meets its local programming responsibilities.<#$  yO'ԍReply at footnote 2.< In that regard, the Commission has held that it is  xonly after "an LPTV station meets its burden of proof by proffering evidence of its local programming"  S ' xthat the burden of proof shifts to the cable operator.$ b  {O' x* ԍSee American Television, Inc. v. Charter Communications, L.L.C., DA 991041 (Cable Serv. Bur.), released June 1, 1999. WVBX has failed to meet that burden.  xFurthermore, we disagree with WVBX's characterization of its alleged local and informational  S ' xprogramming, and the application of the precedent it cites.%"  yO' xM ԍ Vision 3 notes that on weekdays, between 5:00 a.m. and 5:30 a.m., it broadcasts the Washington County  x Weather Report and the School Lunch Bulletin for local schools. Reply at 23. Vision 3 clarifies that WVBX's  x^ local programming "cannot be seen on the programming grid in attachment 2 to the Opposition because that grid  {O8'starts at 6:00 a.m.." Id. footnote n. 1. In Lankenau, the Commission did not hold  xtthat "weather and local school information" aired on a regular basis, constituted local and informational  S6' xprogramming as required by Section 76.55(d)(2) of the Commission's rules.C&6 yO| 'ԍ47 C.F.R.  76.55(d)(2).C Rather, the Commission  xQheld that "weather and news announcements" constituted "program service" under Section 73.1740(2)(iii)  S'of the Commission's rules.'\6 {O#' xx ԍSee Lankenau at 17485, where the Commission noted that "[t]he Station's weather and news announcements  x are not `still pictures' but rather are text that moves continuously across the screen. In addition, these announcements  {ON%'are accompanied by aural transmissions that are related to the visual broadcasts." See 47 C.F.R.  73.1740(2)(iii).  "Z',p(p(88x"Ԍ S' e  13.` ` In conclusion, and as noted above, Section 76.55(d)(2) requires that in order for an LPTV  xstation to be accorded qualified status for must carry purposes in a matter such as this, the Commission  xmust determine that the Station's nonentertainment programming addresses local news and informational  xtneeds which are not being adequately served by full power television broadcast stations because of the  S`' xVgeographic distance of the full power stations from the LPTV's community of license. We are not  xconvinced that WVBX has met its burden of proof demonstrating that it meets the Commission's standards  x7for local and informational programming responsibilities required of low power television stations seeking  S' xmandatory carriage rights.(" {OP' x ԍSee American Television, Inc. v. Charter Communications, L.L.C., DA 991041 (Cable Serv. Bur.), released  x June 1, 1999, where the Commission noted that "an LPTV station meets is burden of proof [that its programming  xH addresses important news and local informational needs of the communities the cable operator serves] by proffering evidence of its local programming." WVBX has failed to introduce any programming logs or other evidence  S' x^supporting its contention that it provides local news and informational programming. In view of WVBX's  xfailure to introduce such evidence, we therefore are unable to conclude that WVBX is a qualified low  Sp' xpower station as contemplated by Section 614(h)(2) of the ActA)p yO'ԍ47 U.S.C.  534(h)(2).A or Section 76.55(d)(2) of the  xCommission's rules. Consequently, WVBX is not entitled to mandatory carriage on the Time Warner system in question.  S ' e 0 14.` ` Although WVBX has not demonstrated that it is a qualified LPTV station for must carry  xpurposes, we believe it instructive to note that Time Warner, in response to the Station's request for  xcarriage, has apparently not conducted engineering tests in accord with accepted Commission standards.  xThe Cable Television Consumer Protection and Competition Act of 1992 ("1992 Cable Act") provides  x"that a cable operator is not required to carry a low power television station that does not deliver [a good  S' xquality signal] to the principal headend of a cable system."S*B {O'ԍSee 47 U.S.C.  534(h)(1)(B)(iii).S Because the cable operator is in the best  xpposition to know whether a given station is providing a good quality signal to the system's principal  x7headend, we believe that the initial burden of demonstrating the lack of a good quality signal appropriately  xcfalls on the cable operator. In meeting this burden, the cable operator must show that it used good engineering practices, as defined below, to measure the signal delivered to the headend.  S' e 415.` ` With respect to the standard to be used to determine what constitutes a good quality signal,  xthe 1992 Cable Act adopted a standard for determining the availability of VHF and UHF commercial  xstations at a cable system's headend: for VHF commercial television station signals, the standard is 45  xdBm; for UHF commercial television station signals, the standard is 45 dBm. Consistent with Congress'  xguidance with respect to VHF and UHF commercial station availability, we believe it is reasonable to  xutilize the same standards as prima facie tests to initially determine, absent other evidence, -'; whether VHF or UHF lowpower stations place adequate signal levels over a cable system's principal headend. S' e 17.` ` In this instance, Time Warner, using a Radio Shack antenna and a Scientific Atlanta QCA xZUHF log periodic antenna with a gain of 12.5 dB, determined that WVBX's signal strength at the Glens  xgFalls headend was below the requisite level of 45 dBm for a UHF commercial station. Time Warner's  x}initial reading at the Glens Falls system headend had three readings between 57 dBm and 56 dBm.  x7Subsequent readings on May 20, 1999, over a period of an hour and twentyone minutes showed a range  xin signal strength between 53.94 dBm and 51.97 dBm. When measured against our criteria for sound  xengineering practices, we conclude that the technical determination reached by Time Warner is insufficient  xcto demonstrate that WVBX's signal is not of "good quality." In this regard, the Commission's rules  xrequire that a cable operator must conduct multiple signal quality tests to ensure accurate results and, in  S ' xturn, provide that testing information to the affected station where there is a dispute over signal level  xmeasurements. Generally, if the tests results are less than 51 dBm for a UHF station, we have said that  xat least four readings must be taken over a two hour period. Where the initial readings are between 51  x dBm and 45 dBm, inclusive, we believe that the readings should be taken over a 24hour period with  xmeasurements not more than four hours apart to establish reliable test results. In this case, however, Time  x^Warner did not cover the twohour period to establish reliable test results. Moreover, it should be pointed  xout that the measurement height used by Time Warner in its second test of WVBX's signal is detrimental  xto the signal strength, considering that the tower is situated at a much higher elevation than the Station's  xtransmitter. In addition, we are persuaded by WVBX that the methodology used by the cable system  xoperator in performing the tests does not meet sound engineering practices.
