On June 9, 1999, Enstar Income/Growth Program Six-B ("Falcon"), filed with the Commission a petition for review of a local rate order adopted by the City of Bowdon, Georgia ("City") on May 10, 1999. In its rate order, the City established new regulated rates for basic service and required Falcon to refund overcharges to subscribers. 2. On August 11, 1999, Falcon filed a Motion to Withdraw its Petition for Review. In its motion, Falcon states that in a recent rate order adopted by the City on July 12, 1999, the City rescinded its May 10, 1999 rate order correcting an error to which Falcon had objected in its Petition. Falcon has now resolved the dispute with the City and therefore has agreed to withdraw the Petition for Review. Falcon indicates that Counsel for the City has stated its concurrence with this motion, therefore, Falcon's motion to withdraw is accepted. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Petition for Review filed by Falcon IS GRANTED and the Petition for Review IS DISMISSED. 4.
