("Bradley's") filed a Petition for Revocation challenging the certification  xof Fayette County, West Virginia, ("the County") to regulate rates for basic cable service and associated  S' xequipment.dXX yO:' x ԍThe County filed its Certification of Franchising Authority to Regulate Basic Cable Rates and Initial Finding  x of Lack of Effective Competition ("FCC Form 328") on October 19, 1998, which became effective November18,  yO'1998. #Xj\  P6G;ynXP#d Bradley's also requests that the Commission stay rate regulation pending resolution of its  S'petition. #n6X@`7&@##&a\  P6G;u&P#The County did not file an opposition to Bradley's petition.  S9' e  2.` ` Section 623(a)(4) of the Communications Act of 1934, as amended, allows franchising  xauthorities to become certified to regulate basic cable service rates of cable operators that are not subject  S' x7to effective competition.X yO['ԍ#X\  P6G;ɒP#Communications Act  623(a)(4), 47 U.S.C.  543(a)(4). DISCUSSION  S' e =3.` ` Bradley's argues that its cable system is subject to low penetration effective competition  xbecause it serves fewer than 30% of the households in unincorporated Fayette County, West Virginia, its  S ' xIfranchise area.  .  yOj' x! ԍ#X\  P6G;ɒP#The 1992 Cable Act and the Commission's rules provide that only the rates of cable systems that are not subject  xM to effective competition may be regulated. Communications Act  623(a)(2), 47 U.S.C.  543(a)(2); 47 C.F.R.   x 76.905(a). One of the bases by which a cable system will be deemed subject to effective competition is if fewer than  x 30% of the households in the system's franchise area subscribe to the system's service. Communications Act  623(l)(1)(A), 47 U.S.C.  543(l)(1)(A); 47 C.F.R.  76.905(b)(1). Specifically, Bradley's asserts that it serves 598 of the 11,506 households (that is,  Si ' xoccupied housing units)- i  yO' x ԍAs the Commission has stated, "we presume that Congress did not intend 'households' to have a different  {O' xM meaning than in the 1990 Census that would include vacant units." Implementation of Sections of the Cable  {Oy' x Television Consumer Protection and Competition Act of 1992: Rate Regulation, Third Order on Reconsideration,  {OC' x 9 FCC Rcd 4316, 4324 (1994) ("Third Order on Reconsideration"). The count of "households" in the 1990 Census  {O ' x reflects only occupied housing units. As supporting documentation,  xBradley's provides 1990 Census data which demonstrates that there are 11,506 households in  S ' xunincorporated Fayette County.F  ^ yO"'ԍBradley's Petition, Exhibit 2.F Bradley's also submits a computer printout with sufficient subscriber  S 'information to support its claim that it serves 598 households in the franchise area.I  {O^$'ԍId., Exhibit 3.I "  ,l(l(,,E"Ԍ S' e q 4.` ` In the absence of a demonstration to the contrary, cable systems are presumed not to be  S' xsubject to effective competition.e  yO5'ԍ#X\  P6G;ɒP#47 C.F.R.  76.906.e The cable operator bears the burden of rebutting the presumption that  xeffective competition does not exist with evidence that effective competition, as defined by Section 76.905  Sg' xQof the Commission's rules, is present within its franchise area.kgX yO_'ԍ#X\  P6G;ɒP#47 C.F.R.  76.911(b)(1).k Bradley's has met this burden. Bradley's  S4' xappropriately relied on Census data reflecting the number of households as required by our regulations.4 {O'ԍ#X\  P6G;ɒP#See Third Order on Reconsideration, 9 FCC Rcd at 4324.  xBradley's has submitted sufficient information demonstrating that its cable system serves 598 of the 11,506  xhouseholds in Fayette County, its franchise area, or 5.2% of the total number of households. Therefore, we find that Bradley's system serving Fayette County is subject to low penetration effective competition.  S5' e 5.` ` Bradley concedes that petitions for revocation pursuant to Section 76.914 of the  xMCommission's rules do not convey a right to an automatic stay, nevertheless, Bradley's requests a stay  S' xpending Commission review of Bradley's Petition for Revocation.Iz {O'ԍSee 47 C.F.R.  76.914. I Bradley's petition presents no  xevidence sufficient to waive the requirement in Section 76.914(d) that local franchising authorities may  Si ' xxcontinue to regulate basic service rates while a petition for revocation is pending before the Commission.Ai  yO'ԍ47 C.F.R.  76.914(d).A Accordingly, Bradley's request for stay of rate regulation is denied.
