Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of: ) ) INTERNET VENTURES, INC. ) INTERNET ON-RAMP, INC. ) ) Petition for Declaratory Ruling regarding) CSR 5407-L whether Internet Service Providers are ) Entitled to Leased Access to Cable Facilities ) under Section 612 of the Communications) Act of 1934, as amended. ) MEMORANDUM OPINION AND ORDER Adopted: July 15, 1999 Released: July 19, 1999 By the Chief, Cable Services Bureau: 1. Internet Ventures, Inc. and its subsidiary, Internet On-Ramp, Inc. (collectively "IVI") filed a Petition for Declaratory Ruling on June 1, 1999 asking the Commission to issue a ruling that Internet service providers are entitled to commercial leased access under Section 612 of the Communications Act of 1934, as amended. By Public Notice, DA 99-1104, issued on June 8, 1999, the Commission established July 13, 1999 as the deadline for the filing of responses to the petition and July 28, 1999 as the deadline for the submission of replies. 2. On July 12, 1999, IVI filed a "Motion for Extension of Time," pursuant to Section 1.46 of the Commission's rules, requesting that the deadline for filing replies be extended by two weeks, until August 11, 1999. IVI argues that its petition has generated substantial public interest and additional time is needed in order for itself and other interested parties to prepare and file replies to the large number of comments anticipated to be received in this proceeding. We grant IVI's Motion for Extension of Time. 3. Accordingly, IT IS ORDERED that the Motion for Extension of Time filed by Internet Ventures, Inc. and Internet On-Ramp, Inc. to file replies until August 11, 1999 in this proceeding regarding its Petition for Declaratory Ruling IS GRANTED. 4. This action is taken by the Chief, Cable Services Bureau, pursuant to authority delegated by Section 0.321 of the Commission rules. FEDERAL COMMUNICATIONS COMMISSION Deborah A. Lathen Chief, Cable Services Bureau
