On November 19, 1998, West Valley Cablevision Industries, Inc. d/b/a Time Warner Communications ("Time Warner"), filed with the Commission a petition for review of a local rate order adopted by the City of Los Angeles, California ("City") on September 30, 1998. The City's rate order established new regulated rates for basic cable service and equipment and required Time Warner to refund overcharges to subscribers. The city filed no opposition to the appeal. 2. On April 30, 1999, Time Warner filed a Motion to Withdraw its Petition for Review. In its motion, Time Warner states it has resolved the dispute with the City and therefore has agreed to withdraw the Petition for Review. Time Warner indicates that Counsel for the City has stated its concurrence with this motion. Therefore, Time Warner's motion to withdraw is accepted. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Petition for Review filed by Time Warner IS GRANTED and the Petition for Review IS DISMISSED. 4.
