ADI Market)  S '  MEMORANDUM OPINION AND ORDER \  S6 'X` hp x (#%'0*,.8135@8: 6 Z$ yO0'ԍPetition at Exhibit 1.> WBDCTV points out that in previous modification cases the  xBureau has taken into account current Nielsen DMA information in adding communities to a station's  S 'market.   $ {OZ' x ԍSee, e.g., Red River Broadcast Corp., 12 FCC Rcd 6090, 6096 (1997); DeSoto Broadcasting, 13 FCC Rcd  {O$'2769, 278182 (1998); and Paxson Phoenix License, 13 FCC Rcd 8555, 8564 (1998).   Sj' e  10. ` ` WBDCTV maintains that adding Hagerstown to its market would allow it to serve an  x important segment of its natural economic market consistent with the intent of Section 614(h)(1)(C).  xxWBDCTV indicates that Hagerstown is geographically contiguous with the Washington, D.C. market and  xthere are no intervening disruptive geographic features such as rivers or mountains. Moreover, WBDCTV  xstates, the sole Hagerstown ADI county is largely surrounded by the existing Washington, D.C. market  Sk' x@and two major interstate highways directly connect Washington, D.C. and Hagerstown.6 kF$ yOQ'ԍPetition at 6.6 In addition,  xWBDCTV states that Hagerstown is included in the U.S. Census Bureau's WashingtonBaltimore  x&Consolidated Metropolitan Statistical Area ("CMSA") and areas consolidated into one CMSA are those  S' x@"considered as a single unit for statistical purposes due to their economic and social integration. . . ."e$ {OH'ԍSee 1996 Rand McNally Commercial Atlas at page 6.e  x WBDCTV argues that the Bureau has previously recognized that the presence of a community in the  Sl'same MSA as a station's city of license is evidence that the community is in that station's market area.lh $ {Ot!' xQ ԍSee, e.g., DeSoto Broadcasting, 10 FCC Rcd 4491, 4494 (1995); and Nationwide Communications, Inc. d/b/a  {O>"'EagleVision, 10 FCC Rcd 13050, 13052 (1995).  S' e  11. ` ` With regard to the four market criteria, WBDCTV argues that while it has not previously  xbeen carried on the Hagerstown cable system, many other Washington, D.C. stations have been carried  S' xpfor years.> $ yO''ԍPetition at Exhibit 2.> Accordingly, WBDCTV states that it is entitled to credit under this criterion. Second,"T ,l(l(,,N"  xWBDCTV states that although its Grade B contour does not quite cover Hagerstown, it should be noted  xthat the geographic distance of 74 miles between the cable communities and the station's city of license  S' xis well within the range of distances previously approved by the Bureau.$ {O'ԍSee Busse Broadcasting Corp., 11 FCC Rcd 6408, 6416, 642225 (1996)(65100 miles). Third, while WBDCTV does  xnot contest the fact that stations licensed to Hagerstown provide some local programming of interest to  x&the Hagerstown community, it maintains that the cable system currently carries no affiliate of the WB  S' x Network and this fact entitles it to credit under the third criterion.Z$ {O' x ԍ See, e.g., Channel 17 Associates, 11 FCC Rcd 4199, 4207 (1996); and WOWTTV, 10 FCC Rcd 4377, 4380 (1995). Finally, WBDCTV admits that it  xdoes not have significant viewership in Washington County, but maintains that it would be illogical to deny its petition based on that fact.  S5' IV. DISCUSSION  S' e  12. ` ` We grant WBDCTV's petition. The cable television mandatory broadcast signal carriage  x^rules were adopted as part of the 1992 Cable Act. According to the legislative history of that Act, the use  x^of ADI market areas is intended "to ensure that television stations be carried in the areas which they serve  S6 ' x3and which form their economic market."Z6 $ yO'ԍH.R. Rep. 102628, 102d Cong., 2d Sess. 97 (1992).Z The Act specifically provided that the Commission was to  xconsider adding additional communities or excluding communities from the markets of television stations  S ' x"to better effectuate the purposes" of the mandatory carriage requirements.= D$ yO'ԍ47 U.S.C. 534(h).= These factors, however, were  S ' x"not intended to be exclusive."Z $ yO'ԍH.R. Rep. 102628, 102d Cong., 2d Sess. 97 (1992).Z In acting on such requests, the Commission was instructed to "afford  Sj' xtparticular attention to the value of localism, taking into account four specified statutory factors."1jd $ {On'ԍId.1 We  xbelieve that the addition of the communities herein to WBDCTV's television market will better effectuate the purposes of the must carry statutory provisions.  S' e AԊ 13. ` ` In an analysis of the four statutory factors for market modification we find that WBDCTV  xmeets the historic carriage factor because other stations licensed to Washington, D.C., and with which  xDWBDCTV competes, have been historically carried on the Hagerstown system. With regard to the other  xmodification factors, we note that the subject communities are not encompassed by WBDCTV's predicted  x7Grade B contour and WBDCTV has minimal viewership in Washington County. However, other factors  x*override these deficiencies. WBDCTV is carried on cable systems surrounding the Hagerstown system,  xincluding communities more distant from Washington, D,C., and numerous other "stations located in the  xsame area" as WBDCTV are being carried on the system. This evidence demonstrates that Hagerstown  xcable subscribers have a commonality of interest with the Washington, D.C. area and provides evidence" ,l(l(,,"  S' xof the scope of WBDCTV's market.(ɥ {Oh' x ԍThe Commission noted, in its Report and Order and Notice of Proposed Rulemaking in Docket CS 95178,  x 11 FCC Rcd 6201, para. 46 (1996) that DMA market designations could be useful in deciding individual cases"  x^ under Section 614(h). We note that under the Nielsen based DMA market definition system (in contrast with the  x Arbitron ADI system now in use) the cable system here in question would already be part of the market of WBDCTV. ( WBDCTV appears to be one of the "hub" stations in the market  S'with its programming and advertising being of widespread interest across the area.zɥ {O'ԍ Compare WLNYTV, Inc. et al. v.
