On March 23, 1999, TCI of Seattle, Inc. ("TCI-S") and the City of Seattle, Washington ("City") jointly moved to terminate Commission review of local rate orders in the above captioned proceedings without benefit of substantive Commission review. TCI had filed appeals of three City rate orders: Ordinance CTV-95-003 (filed July 5, 1995); Ordinance CTV-96-002 (filed June 17, 1996); and Ordinance CTV-97-001 (filed August 11, 1997). The Cable Services Bureau ("Bureau") released a Memorandum Opinion and Order, DA 98-488 (March 12, 1998), denying TCI-S' appeal of Ordinance CTV-95-003, and TCI-S filed a Petition for Reconsideration of the Bureau order on April 13, 1998. TCI-S also filed requests for stay of Ordinances CTV-96-002 and CTV-97-001. TCI-S and the City withdraw with prejudice all such appeals, stay requests, and the petition for reconsideration, as well as subsequent filings related to this proceeding. 2. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeals of Local Rate Orders filed by TCI of Seattle, Inc. and the City of Seattle, Washington IS GRANTED and the petition for reconsideration, appeals and emergency stay requests filed by TCI-S ARE DISMISSED. 4.
