On March 23, 1999, District Cablevision L.P. ("DCLP") and the City of Washington, D.C. ("City") jointly moved to terminate Commission review of a local rate order in the above captioned proceeding without benefit of substantive Commission review. DCLP had filed an appeal on March 31, 1997 from a local rate order adopted by the City on February 28, 1997. The Cable Services Bureau ("Bureau") released a Memorandum Opinion and Order, DA 98-1097 (June 11, 1998), denying DCLP's appeal and DCLP filed a Petition for Reconsideration of the Bureau order on July 13, 1998. DCLP also filed a request for stay. DCLP and the City withdraw with prejudice such appeal, stay request, and the petition for reconsideration, as well as subsequent filings related to this proceeding. 2. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeals of Local Rate Orders filed by District Cablevision and the City of Washington, DC IS GRANTED and the appeal, petition for reconsideration and emergency stay request filed by DCLP ARE DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by Section 0.321 of the Commission's rules, 47 C.F.R  0.321.
