On June 18, 1998 TCI TKR of the Metroplex, Inc. ("TCI-M"), filed with the Commission an appeal of a local rate order adopted by the City of Colleyville, Texas (the "City") on May 19, 1998. TCI-M also filed a Request for Emergency Stay of the local rate order on June 26, 1998. In the local rate order, the City established new regulated rates for basic cable service and associated equipment. The City's rate order required TCI-M to reduce the rates charged for certain equipment and installation. 2. In a Joint Motion to Withdraw Appeal of Local Rate Order filed on March 5, 1999, TCI-M and the City together ask that the appeal filed on June 18, 1998, and the Request for Emergency Stay and all subsequently filed pleadings related to these proceeding be withdrawn and dismissed without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeal of Local Rate Order filed by TCI TKR of the Metroplex, Inc. and the City of Colleyville,TX IS GRANTED and the Appeal and Request for Emergency Stay filed by TCI-M ARE DISMISSED. 4.
