On November 30, 1995, we issued an Order  {OX-ԍ See In the Matter of Social Contract for Time Warner, 11 FCC Rcd 2788 (1996). approving a Social Contract ("Social   jContract") which Operator entered into with the Federal Communications Commission ("Commission").   This Order addresses only the reasonableness of Operator's CPST rate increase, consistent with the terms of the Social Contract, effective January 1, 1996.  S-  22.` ` Under the Communications Act, {O"-#X\  P6G;P#э Communications Act, Section 623(c), as amended, 47 U.S.C. 543(c) (1996). the Commission is authorized to review the CPST rates   of cable systems not subject to effective competition to ensure that rates charged are not unreasonable.  S-  The Cable Television Consumer Protection and Competition Act of 1992 ("1992 Cable Act")UD yOd-ԍ Pub. L. No. 102385, 106 Stat. 1460 (1992).U required   the Commission to review CPST rates upon the filing of a valid complaint by a subscriber. To justify  S0-  jrates for the period beginning May 15, 1994, operators must use the FCC Form 1200 series.0 {O"-ԍ#X\  P6G;P# See Section 76.922 of the Commission's Rules, 47 C.F.R. 76.922. Operators  S-  jare permitted to make changes to their rates on a quarterly basis using FCC Form 1210.Zf  {O%-ԍ#X\  P6G;P#  Id.Z Operators may   .justify their rates on an annual basis using FCC Form 1240 to reflect reasonably certain and quantifiable   ychanges in external costs, inflation, and the number of regulated channels that are projected for the twelve" ,**88"  S-  =months following the rate change.Z* {Oh-ԍ#X\  P6G;P#  Id.Z Any incurred cost that is not projected may be accrued with interest  S-and added to rates at a later time.ZZ* {O-ԍ#X\  P6G;P#  Id.Z  S-  3.` ` Subsequent to the Social Contract, Operator was given permission by Commission staff   to file bifurcated FCC Form 1240s. In these bifurcated forms, Operator calculates the $1.00 annual   increase permitted by the Social Contract ("Social Contract Dollar") and its trueup on a separate FCC   zForm 1240 ("SCD Form 1240"). On the SCD Form 1240, Operator calculates its trueup adjustment   through to the effective date of the rate increase. On its other FCC Form 1240, Operator calculates the   0other adjustments to its CPST rate adjusting its trueup period to conform with FCC Form 1240  S-Instructions. * {O$ -  ԍ The trueup data is intended to indicate real, not projected data. See In the Matter of Implementation of   JSections of the Cable Television Consumer Protection and Competition Act of 1992: Rate Regulation, MM Docket  {O-  No. 92266, Thirteenth Order on Reconsideration ("Thirteenth Reconsideration Order"), 11 FCC Rcd 388, 420 at  {O-  n.151 (1996). The period for the trueup will not coincide with the previous year's projections. Id. This policy is  {OJ-reflected in the instructions accompanying FCC Form 1240. See FCC Form 1240 Instructions, "Timing" at pp. 34.   SH -  4.` ` Upon review of Operator's bifurcated FCC Form 1240 methodology, we find Operator's  S -  jmethodology acceptable.| * {Od-ԍ See In the Matter of Time Warner Cable, DA 98714 (released April 16, 1998).| It allows Operator to collect its Social Contract Dollar each year, and to true  up any applicable part of its Social Contract Dollar, within the calendar years covered by the Social  S -  Contract.K 6 * yO-ԍ Social Contract, Section III.F.4.K In the present case, we will allow Operator to file its bifurcated FCC Form 1240s because we   -instructed Operator to make such filings. Absent such explicit instructions, we would reject the FCC Form   1240s filed by Operator. Further, our acceptance of Operator's bifurcated FCC Form 1240 methodology still requires that we review Operator's calculations on these FCC Form 1240s.  S-  B5.` ` Upon review of Operator's FCC Form 1240s for the projected period January 1, 1996  S-  =through December 31, 1996, we accept Operator's filings and find that Operator has correctly calculated   its maximum permitted rate ("MPR") of $12.16. Because Operator's actual CPST rate of $11.57, effective  S-January 1, 1996, does not exceed its MPR, we find Operator's actual CPST rate to be reasonable.  * yO-  wԍ These findings are based solely on the representations of Operator. Should information come to our attention   Ythat these representations were materially inaccurate, we reserve the right to take appropriate action. This Order is   not to be construed as a finding that we have accepted as correct any specific entry, explanation or argument made by any party to this proceeding not specifically addressed herein.
