In this Order we consider the refund plan filed by the above-captioned operator ("Operator") in the above-captioned community pursuant to our order In the Matter of Comcast Cablevision ("Refund Order"). Our review of Operator's refund plan reveals that Operator has not correctly calculated the interest due for a portion of the time period covered by the Refund Order. 2. Specifically, we find that Operator has correctly calculated the refund principal due of $243,038.35 for the period November 3, 1997 through March 31, 1998. Operator has also correctly calculated the interest amount due for the period November 3, 1998 through March 31, 1998 as $4,050.64. For the period April 1, 1998 through September 30, 1998, Operator has calculated interest as $4,253.17 and achieved this result by multiplying the refund principal due by 0.5. However, because the refund principal due had already fully accrued as of March 31, 1998, multiplying the refund principal due by 0.5 is incorrect and causes the calculated interest to be understated by $4,253.17. We order Operator to make this adjustment in its refund calculations in order to comply with the Refund Order. 3. Accordingly, Operator's Refund Plan IS APPROVED, provided Operator modifies its Refund Plan to the extent indicated herein, and IT IS ORDERED, pursuant to Section 76.962 of the Commission's Rules, 47 C.F.R. Section 76.962, that Operator implement its modified refund plan within 60 days of the release of this Order. 4. IT IS FURTHER ORDERED, pursuant to section 76.962 of the Commission's Rules, 47 C.F.R. Section 76.962, that Operator file a certificate of compliance with the Chief, Cable Services Bureau, with 90 days of the release of this Order, certifying its compliance with this Order. 5. This action is taken pursuant to Section 0.321 of the Commission's Rules, 47 C.F.R. Section 0.321. FEDERAL COMMUNICATIONS COMMISSION Margaret M. Egler Acting Chief, Financial Analysis and Compliance Division Cable Services Bureau
