INTRODUCTION 1. Willow Park Cable TV ("Willow Park") has filed with the Commission a petition for reconsideration of the Cable Services Bureau's Memorandum Opinion and Order in the above-captioned proceeding ("Order") insofar as that decision ordered Willow Park to add the signal of television broadcast station KINZ(TV), (Channel 68), Arlington, Texas ("KINZ") to its cable system serving the community of Millsap, Texas. KINZ did not file an opposition to the petition for reconsideration. II. BACKGROUND AND SUMMARY OF PLEADINGS 2. In the Order, we granted KINZ's request for mandatory carriage on Willow Park's cable systems based upon KINZ's allegation that Willow Park had not met its obligation to allocate one-third of its usable activated channel capacity to local commercial television stations on its River Oaks system and on its Aledo, Texas system serving Parker County. The specific communities in Parker County in which KINZ sought carriage includes Millsap, among others. In its petition for reconsideration, Willow Park asserts that KINZ mistakenly included the community of Millsap in its must-carry complaint. Willow Park explains that, although Millsap is located within Parker County, Millsap is not served by Willow Park's Aledo system serving Parker County. Willow Park maintains that KINZ should not have included the community of Millsap in its must-carry request. III. DISCUSSION 3. We will grant Willow Park's petition for reconsideration of the Order to exclude the community of Millsap from KINZ's grant of mandatory carriage on Willow Park's systems serving River Oaks and Parker County, respectively. It appears that KINZ mistakenly included the community of Millsap in the caption of its petition but in its complaint sought mandatory carriage only on Willow Park's systems which did not meet the one-third channel capacity requirement, namely, Willow Park's River Oaks and Aledo cable systems. The community of Millsap is not served by Willow Park's Aledo system, the system on which KINZ sought carriage; thus, that community should not have been included in KINZ's grant of mandatory carriage. Accordingly, we grant Willow Park's petition. IV. ORDERING CLAUSE 4. Accordingly, IT IS ORDERED that the petition filed by Willow Park Cable TV [CSR-4939- M] for reconsideration of our decision in United Broadcast Group II, Inc. IS GRANTED. 5.
