In this Order we consider the refund plan filed by the above-captioned operator ("Operator") in the above-captioned community pursuant to our order In the Matter of Time Warner Cable ("Refund Order"). Our review of Operator's refund plan reveals that the refund plan fulfills the requirements of the Refund Order. Because Operator will not be required to implement its refund plan until 30 days after the release of an order denying its Petition for Special Relief, CSR-5098-E, we will require Operator to update its refund plan to include principal and interest accumulated up to the date of implementation. 2. Accordingly, Operator's Refund Plan IS APPROVED and IT IS ORDERED, pursuant to Section 76.962 of the Commission's Rules, 47 C.F.R. Section 76.962, that Operator implement its refund plan within 30 days of the release of an order denying Operator's Petition for Special Relief, CSR-5098-E, provided Operator updates its refund plan to include principal and interest accumulated up to the date of implementation. 3. IT IS FURTHER ORDERED, pursuant to Section 76.962 of the Commission's Rules, 47 C.F.R. Section 76.962, that Operator file a certificate of compliance with the Chief, Cable Services Bureau, within 30 days of implementation of its refund plan certifying its compliance with this Order. 4.
