TCI Cablevision of Woodhaven, Inc. ("TCI Cablevision") filed an opposition to the  d(#Lpetition for reconsideration, and MediaOne filed a response to the petition for relief. Because the issues  d(#raised in both matters are similar, the two matters are consolidated and considered in this order. For the reasons stated below, both petitions will be denied.  S - 2.` ` The 1984 Cable Act 2 yOg#-ԍCable Communications Policy Act of 1984, Pub. L. No. 98549, 98 Stat. 2779 (1984).Ā imposed on cable operators commercial leased access requirements  d(#designed to assure access to cable systems by unaffiliated third parties who have a desire to distribute  d(#video programming free of editorial control of cable operators. Channel set aside requirements were  S#- d(#established proportionate to a system's total activated channel capacity. The 1992 Cable Act#X2 yO'- d(#<ԍCable Television Consumer Protection and Competition Act of 1992, Pub. L. No. 102385, 106 Stat. 1460  {OG(-(1992). See Section 612(b) of the Communications Act of 1934, as amended, 47 U.S.C. 532(b) revised the  d(#>leased access requirements and directed the Commission to implement rules to govern this system of"_$,**88%"  S- d(#channel leasing. In its 1993 Report and Order and Further Notice of Proposed Rule Making ("Rate  S- d(#\Order"),> yOB-ԍ8 FCC Rcd 5631 (1993).> the Commission adopted new rules for leased access addressing maximum reasonable rates,  d(#reasonable terms and conditions of use, minority and educational programming, and procedures for  S- d(#[resolution of disputes.iX {O-ԍSee 47 C.F.R. 76.970, 76.971, 76.975 and 76.977 (1995).i The Commission recently modified some of its leased access rules in the Second  Sf- d(#Report and Order and Second Order on Reconsideration of the First Report and Order ("Second Order").a\f {O- d(#-ԍFCC 9727 (released February 4, 1997), 62 Fed. Reg. 11364 (1997).  See also Order on Reconsideration of  d(#the First Report and Order and Further Notice of Proposed Rulemaking in MM Docket No. 92266 and CS Docket  {O -No. 9660, 11 FCC Rcd 16933 (1996).a   S@- d(#In the Second Order, the Commission, among other things, confirmed that its regulations regarding  S- d(#reasonable terms and conditions of use for commercial leased access= yO -ԍ47 C.F.R.  76.971= do not deny cable operators the right  S-to require reasonable liability insurance coverage for leased access programming.K {O0-ԍSee Second Order at  112.K  S-" The Petition for Reconsideration ă  SR - #3.` ` FalComm, an independent producer of video programming, in a petition for relief in CSR  d(#5117L filed under Section 76.975 argued that TCI Cablevision may not demand, as a condition of getting  d(#yleased access capacity, a $1,000,000 broadcasters liability insurance policy, with TCI Cablevision named  S - d(#[as a coinsured party. The Bureau Order in CSR5117L reviewed the Commission's requirements under  d(#ywhich cable operators may demand insurance from leased access users and held that TCI Cablevision had  S - d(#met its burden in this regard. 0  {O\-ԍSee Bureau Order, at  6. There is no need to reiterate those requirements here. The Bureau Order further found that a $165 annual premium for adding  d(#the cable operator as an additional insured party on FalComm's policy did not appear unreasonable on  S>- d(#{its face, and denied the petition for relief. Additionally the Bureau's Order concluded that it was reasonable for TCI Cablevision to require that it be named as an insured on FalComm's insurance policy.  S- R4.` ` FalComm seeks reconsideration of the Bureau Order on grounds that for it to gain  d(#carriage on the eight cable systems in the Detroit, Michigan area it would have to pay insurance fees in  Sz- d(#the amount of $1320. z  yO - d(#xԍThis represents a payment of $165 for each of the eight systems Falcomm seeks carriage on in the Detroit, Michigan area. Further, FalComm argues that it should not have to name TCI Cablevision as  d(#zbeneficiary on its insurance policy. FalComm maintains that the $1320 cost represents a significant  d(#barrier for a small independent video programmer, and demonstrates that insurance requirements in the aggregate are unreasonable.  S-  5.` ` We reject this line of argument, which was considered and rejected in the Bureau Order.  d(#The relevant fact is that the additional cost to FalComm of adding TCI Cablevision as another insured  Sd- d(#.party is $165, an amount found reasonable in the Bureau Order. FalComm has introduced no evidence"d ,`(`(88"  d(#which persuades us to change our underlying decision. The fact that FalComm will have to pay similar  d(#sums to obtain carriage on other systems does not undermine our earlier decision. Our leased access rules  d(#apply on a system wide basis. Moreover, while FalComm's insurance costs would increase for every  d(#.system on which it gained carriage, its revenue would also grow depending on the number of subscribers on the new systems.   S- %6.` ` FalComm's further argument that the cable operator should be content to accept a  d(#certificate of insurance rather than being named as an additional insured party on FalComm's policy is  S- d(# inconsistent with the Second Order, which concluded that cable operators may require leased access  S- d(#kprogrammers to provide reasonable insurance coverage.K  {O -ԍSee Second Order at  112.K In this connection, a certificate of insurance naming FalComm alone would not provide coverage for TCI Cablevision.  S" -jA The Petition for Relief ă  S - $7.` ` FalComm's petition for relief against MediaOne in File No. CSR 5135L presents the  d(#same arguments that were raised regarding aggregate insurance costs in the underlying decision in CSR d(#5117L. MediaOne has presented essentially the same information in justification of its insurance  SZ- d(#requirement that was presented by TCI Cablevision and found reasonable in the Bureau Order in CSR d(#.5117L. Because we have fully considered these matters as set out above, we see no need to readdress  d(#them separately in this case. Accordingly, we conclude that FalComm's petition in File No. CSR 5135L should also be denied.
