On April 20, 1995, Community TV Corporation ("Community TV"), filed with the Commission a petition for review of a local rate order adopted by the Town of Alton, New Hampshire (the "Town") on March 21, 1995. The rate order dealt with several issues which had been remanded in an order released on February 6, 1995 by the Cable Services Bureau in an appeal from an earlier rate order the Town adopted on October 31, 1994. Community TV also filed a Petition for Stay and a Petition for Review on July 21, 1995 of a subsequent rate order issued by the Town on June 21, 1995. In its March 21, 1995 order the Town instructed Community TV to reduce certain service and equipment rates and refund overcharges to subscribers. 2. In a Joint Motion to Withdraw Petition for Review of Local Rate Order filed June 3, 1998 and supplemented by the June 25, 1998 letter from Janell Fonsworth Coles to Magalie Roman Salas, Community TV and the Town ask that the March 21, 1995 and July 21, 1995 petitions for review and associated pleadings in the above-captioned proceedings be withdrawn and dismissed without substantive Commission review. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Petition for Review of Local Rate Order filed by Community TV Corporation and the Town of Alton, New Hampshire on June 3, 1998, as supplemented on June 25, 1998, IS GRANTED and the petitions for review filed by Community TV Corporation on March 21, 1995 and July 21, 1995 and the petition for stay filed on July 21, 1995 ARE DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by  0.321 of the Commission's rules, 47 C.F.R.  0.321.
