On January 24, 1995, Time Warner Entertainment-Advance/Newhouse Partnership d/b/a Time Warner Cable ("TWE-A/N), (formerly Vision Cable of North Carolina), filed with the Commission a Petition for Interlocutory Review of Initial Decision of a local rate order adopted on November 21, 1994 by the Town of Burgaw, North Carolina (the "Town"). The Town's order made an initial determination regarding the status of TWE-A/N's a la carte channel offerings. 2. On March 12, 1998 TWE-A/N filed with the Commission a letter requesting the petition for Interlocutory Review of Initial Decision be dismissed on the grounds that the underlying dispute has been rendered moot by the Time Warner Social Contract. 3. Accordingly, IT IS ORDERED THAT TWE-A/N's petition for interlocutory review of the rate order issued by the Town of Burgaw, North Carolina IS DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules, 47 C.F.R.  0.321.
