On March 21, 1997, Robin CableSystems of Tucson, d/b/a TCI of Tucson ("Robin"), filed with the Commission an appeal of a local rate order adopted on February 24, 1997 by the City of Tucson, Arizona (the "City"). Robin also filed a request for emergency stay of the rate order. In its rate order, the City established Robin's rates for basic service and associated equipment and required Robin to refund overcharges to subscribers. 2. On February 26, 1998 , Robin filed with the Commission a motion to withdraw its appeal and request for emergency stay. In its motion Robin states that it has reached an acceptable resolution of this matter with the City and requests that both filings be dismissed without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED THAT Robin CableSystems' motion to dismiss its appeal and request for emergency stay of the rate order issued by the City of Tucson, Arizona IS GRANTED and the appeal IS DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules, 47 C.F.R.  0.321.
