The Cities of Margate, Miramar, Plantation, Tamarac, and Weston state that Glades failed  x-to indicate on its Form 1275 whether it intends to construct new physical plant within the public rightsof xyway of each community. The Cities of Coconut Grove and Deerfield Beach, and Broward County assert  xthat Glades has not been certified as a local exchange carrier ("LEC") or any other type of  xtelecommunications service provider by the Florida Public Services Commission. The City of Deerfield  x[Beach opposes Glades' certification application because it believes that LECs are the only entities which  xare eligible to obtain certification to become open video system operators. In addition, the City of  xDeerfield Beach argues that Glades' service of its open video system certification application was deficient  xbecause Glades served the City's Risk Manager instead of the City Clerk and that the fiveday time period  xwithin which comments must be filed is inadequate to permit a meaningful response and deprived the City of due process.  S - III.xDISCUSSION  S -  S - `  x 5. ` ` We have reviewed the information contained in Glades' Form 1275. Glades has applied  xzto become a certified open video system operator in the Communities within the State of Florida. As  xrequired by Form 1275, Glades' certification application provides: company information and a separate  xstatement of ownership, including all affiliated entities; eligibility and compliance representations; and  xMsystem information, system capacity and verification statements. Glades indicates that it has served  xofficials of the communities affected by its application in the State of Florida which are the designated telecommunications officials of those respective communities.  Sh- ` ox6.` ` We have also reviewed the comments and opposition filed in response to Glades' Form  x1275. As an initial matter, we note that Congress has required the Commission to approve or disapprove  S- xany open video system certification application within ten days of receipt. E yO-#X\  P6G;ɒP#эCommunications Act  653(a)(1), 47 U.S.C.  573(a)(1). In order to accommodate the  xfiling of comments within this time constraint, the Commission has required comments and oppositions  S- xto be filed within five days of the applicant's filing. XE {O- x#X\  P6G;ɒP#эImplementation of Section 302 of the Telecommunications Act of 1996, Open Video Systems, Fourth Report and  {O-Order, 12 FCC Rcd 7545 (1997). The Commission's rules provide for the most  xefficient review of open video system certification applications and related pleadings within the statutory time frame.  S(- ` _ x7.` ` Each commenter has raised the issue of the sufficiency of the information Glades provided  xon its Form 1275 pertaining to its anticipated analog and digital capacities. The tenday statutory review  S- xperiod for certification applications requires us to confine our review to the Form 1275. Form 1275  xrequires an open video system operator applicant to state its anticipated channel capacity. The  xCommission requires certification applicants to state analog and digital portions of the open video system  S`- xseparately and to treat them separately for channel allocation purposes. `E {O$-#X\  P6G;ɒP#эSee Second Report and Order, 11 FCC Rcd at 18262.Ē Glades states on its Form 1275  S8- xLthat it anticipates offering digital capacity of 1000 MHz and analog capacity of 234 channels.8FE {O'-#X\  P6G;ɒP#эSee answers to questions D.2 and 3 on Glades' FCC Form 1275. Nothing"8,`(`(88 "  xin the Telecommunications Act of 1996 or in the Commission's rules governing open video system  x.certification requires us to dertermine whether an applicant's anticipated digital and analog capacities are  x\consistent. The Form 1275 does not require an applicant to provide technical specifications beyond  S-anticipated capacity or to describe the manner in which the anticipated capacity will be delivered.E {O-#X\  P6G;ɒP#эSee Section 653(a)(1) of the Communications Act and 47 C.F. R.  76.1500 et seq.Į  S8- ` Bx 8.` ` With regard to the issue of Glades' failure to state whether it intends to construct new  xphysical plant, Form 1275 does not require an applicant to do so. Section 76.1502(a) of our rules does  xLrequire that, if construction is necessary, an applicant must become certified prior to the commencement  xof construction and that, if no construction is required, the applicant must become certified prior to  S- x1commencement of service.iZE yO -#X\  P6G;ɒP#э47 C.F.R.  76.1502(a).i None of the commenters has alleged that Glades has commenced  xMconstruction of a new physical plant or commenced delivery of open video service in violation of the  xlCommission's rules. In addition, our open video system rules require certified open video system  xoperators to comply with all State and local conditions for the use of public rightsofway as long as such  S - xconditions are applied equally to all users of the public rightsofway. E {O-#X\  P6G;ɒP#эSee Second Report and Order, 11 FCC Rcd at 18330. In establishing open video  xsystems as an alternative method of providing video service, Congress sought to avoid erecting barriers  xto entry and creating potential for delay in the certification process. The Commission, while  x/acknowledging that the certification process was designed to be streamlined, has stated its belief that  x"Congress did not intend to infringe upon local communities' prerogative to manage their public rightsof S0- xway in order to protect the public health and safety."0|E {OL-#X\  P6G;ɒP##X\  P6G;ɒP#эId., 11 FCC Rcd at 18329. Ĝ Thus the Commission has made clear that the open  xvideo system certification process does not usurp the authority of local governments to manage the rightsofway within their communities.  S- ` $x9.` ` With regard to the comments regarding Glades' lack of prior certification as a LEC or a  xjtelecommunications provider, there are no precertifications or approvals necessary to obtain open video  xzsystem certification. Glades is not required to be a LEC in order to become certified as an open video  xsystem operator. Section 76.1502 of the Commission's rules describes the qualifications for open video  x.system certification and states, in relevant part, that any person may obtain a certification to operate an  S- xopen video system.E {Ov-#X\  P6G;ɒP##X\  P6G;ɒP#э47 C.F.R.  76.1501; see also 47 C.F.R.  76.5(aa) (definition of "person"). Nothing in the Communications Act, or the Commission's rules governing the  xjcertification process, requires an applicant to demonstrate or to make a representation that it is currently  Sx-a facilitiesbased service provider.xE yO"- x#X\  P6G;ɒP#эIn fact, the Commission has made clear that entities other than LECs may become open video system operators.  {O#- xSee Third Report and Order, 11 FCC Rcd. at 20237, 20241;  Second Report and Order, 11 FCC Rcd. at 1823242.  {OJ$- xJ LECs, however, are precluded from offering open video system services within their telephone service areas. Third  {O%- xhReport and Order and Second Order on Reconsideration, 11 FCC Rcd. at 20237, 20241; Second Report and Order, 11 FCC Rcd. at 1823242. "PV ,`(`(88"Ԍ S- ` o x10.` ` The City of Deerfield Beach argues that Glades did not serve the proper city official as  xrequired by the Commission's rules and that the fiveday comment period deprived the City of a  xLmeaningful opportunity to be heard. With regard to the service of process issue, the City cites our prior  S- x=decision in Urban Communications Transport Corporation\E {O- x#X\  P6G;ɒP#э#X\  P6G;ɒP#11 FCC Rcd 17495 (1996) ("Urban"). Urban subsequently perfected its deficient service and was certified as  {O- xan open video system operator. See Urban Communications Transport Corporation, Consolidated Order, 12 FCC Rcd 1336 (1997). in which we denied the open video system  xcertification application based in part upon deficient service of the open video system certification  S:- x>application to the affected communities. We find that this case can be distinguished from Urban. In  S- xjUrban, the applicant served the clerk of Westchester County, New York but did not serve the numerous  S- xmunicipal local franchising authorities located within Westchester County.|E {Oz -#X\  P6G;ɒP#эUrban, 11 FCC Rcd at 17497.| In the instant case, Glades  x/has served each of the communities affected by its open video system application with a copy of its  xycertification application and has made a representation that, before making such service, it contacted each  Sv- xcommunity to determine the appropriate official to be served.s v~E yO- x#X\  P6G;ɒP##X\  P6G;ɒP#эCommission staff discussed the matter of service of process with Glades prior to the filing of its certification  xapplication. Glades represented that it telephoned each community to ascertain the proper official to be served with  xits open video system certification application. In this regard, it appears that a City of Deerfield Beach employee may have inadvertently directed Glades to serve the City's Risk Manager with its certification application.s We note that the City of Deerfield Beach  xLfiled extensive comments prepared by its City Attorney addressing substantive arguments in addition to  xthe service of process issue within the fiveday time frame required by our rules. In light of these facts,  x/we cannot conclude that Glades' deficient service, if indeed such service was deficient, has materially  xinfringed upon the City of Deerfield Beach's ability to fully and fairly address the issues raised by Glades' certification application.  S^- ` Qx11.` ` With regard to the City of Deerfield Beach's argument that the limited comment period  xydeprives it of due process, we have noted the brief tenday period in which the Commission must review  S- xopen video system certification applications.f E {O-#X\  P6G;ɒP#эSee supra  2, 3, 6, discussing the statutory review period for open video system certification applications. The Commission established the fiveday comment period  xin order to provide affected parties with the maximum opportunity to be heard within the time constraints of the application review period mandated by statute.  Sn- ` ~x12.` ` We find that Glades has provided the requisite facts and representations concerning the  xopen video system it intends to operate and has certified that it "agrees to comply and remain in  xcompliance with each of the Commission's regulations" under Section 653(b) of the Communications Act.  xWe note that, if any representation in Glades' certification filing proves to be materially false or materially  xMinaccurate, the Commission retains the authority to revoke Glades' certification or impose such other  xpenalties it deems appropriate, including forfeiture. We further find that the comments and opposition have not raised issues which warrant denial of Glades' open video system certification application.
