In this regard, both  S`- xPaxson and Sonic agree.X`E yO- xԍComplaint, Exhibit 2; Opposition, Exhibit C (Letter dated November 6, 1997, from Sonic's General Manager,  x;Randall Lee, to Tom Camarada, Station Manager, KOOGTV); Opposition, Exhibit A (Declaration of Randall Lee); and Opposition, Exhibit G (Declaration of Chester Redd, Engineering Manager, Sonic Cable Television of Utah). Thus, we find that the station is not entitled to mandatory carriage on Sonic's  S8- x Logan system, and will deny Paxson's complaint. Paxson unquestionably understands the statutory  xjrequirement in question. In its Reply, Paxson accepts that: "[t]he mustcarry rules require that a station  xdeliver a good quality signal to the 'principal headend of a cable system' in order to be eligible for  S- xcarriage."4E yOH -ԍReply, at 2.4 Realizing its inability to deliver a good quality signal to Sonic's Logan headend, Paxson  xargues that KOOGTV should be allowed to deliver a good quality signal to the Clarkston receive site,  Sp- xinstead of Sonic's principal headend. To bolster its argument, Paxson cites certain language>pxE {O-ԍSee, Footnote 8.> in the  SH - xCommission's Clarification Order, which Paxson believes requires cable operators to give broadcast  xlstations the kind of "cooperation" KOOGTV seeks the use of the Sonic's receive site. Paxson's  xLunderstanding of the type of cooperation the Commission expects from cable operators to resolve must xcarry problems is misplaced. Anteceding the language cited by Paxson, the Commission noted that it was  xMreferring to the cooperation cable television operators had to give broadcast stations trying to resolve  x\signal delivery or copyright liability problems before June 2, 1993, in order to retain their mustcarry  SZ-rights.MZ E {O-ԍClarification Order, at  5.M  S -  N7.xThe Statute as well as the Commission's rules clearly indicate that a commercial broadcast station  S- xis entitled to mandatory carriage if it, inter alia, can "deliver to the principal headend of a cable system  S- xeither a signal level of 45 dBm for UHF signals or 49 dBm for VHF signals."cE yO-ԍ47 U.S.C.  534(h)(3)(iii); 47 C.F.R.  76.55(c)(3). c Furthermore, in In re:  S- xLComplaint of Family Stations, Inc., against Sonic Cable Television,, E yOb- xԍCSR4274M, DA 951627 (released August 2, 1995). In that case, the Complainant broadcast station argued  x;that the signal strength measurement in question should be taken at the cable operator's microwave transmit station  xwrather than at the cable system's principal headend. There, the Commission denied the complaint and cited language  {O - xin the Clarification Order that specifies that "cable operators need not employ extraordinary measures or specialized equipment when making measurement for stations that are not currently carried." the Commission determined that its  x!rules do not require cable operators to transport a station's signal to a cable system's headend via  x=microwave. Moreover, the Commission clarified this issue when it said: "[a]s the statute specifies that  xa broadcast station must deliver a good quality signal to the principal headend of the cable system to be  xLentitled to mustcarry rights, we clarify that the designated principal headend is the appropriate location  S- xfor such [signal strength] measurements."JE {ON'-ԍClarification Order,  8.J In seeking permission to use the receive site as the appropriate"p,`(`(88"  x@location for the delivery of a good quality signal, Paxson, in essence, is attempting to have the  xCommission change this requirement. As a result, the use of the Clarkston Ridge facility as the test site  xfor KOOGTV's signal would not be in compliance with either the Cable Television Consumer Protection  xand Competition Act of 1992 or the Commission's rules. However, should Paxson be able to provide a good quality signal to Sonic's principal headend, then it would be entitled to carriage.  S-< ORDER ă  S-   8.xFor the foregoing reasons, IT IS ORDERED , pursuant to  614 of the Communications Act, that  xythe Complaint filed December 31, 1997 in File No. CSR5192M by Paxson Salt Lake City License, Inc.
