Horizon Cable I Limited Partnership, 12 FCC Rcd 17360 (CSB 1997)  {O- xx("Horizon I"); and  Horizon Broadcasting Corporation v.Cablevision of Michigan, Inc., 12 FCC Rcd 17365 (CSB  {O-1997) ("Horizon II").m Horizon Cable I Limited Partnership ("Horizon") and Cablevision of Michigan, Inc.  x("Cablevision"), respectively, have filed oppositions to the petitions. Because the issues raised in both petitions are similar, we consolidate the two captioned proceedings for consideration in this order.  S(- ` _` hp` pЊx2.` ` Our decisions in Horizon I and Horizon II denied complaints filed by WJUETV pursuant  xto 47 C.F.R.  76.7 and 76.61 for carriage on the cable systems of Horizon and Cablevision, on the  xgrounds that the complaints were untimely filed under the provisions of 47 C.F.R.  76.7(c)(4)(iii)(B).  xWe found in both cases that by letters dated January 9, 1997 WJUETV made demands for carriage on  xthe respective cable systems. We also found that WJUETV did not file a complaint with the Commission  xin either case until June 6, 1997, almost five months later. Because WJUETV's complaints were not filed"b,**88"  S- x=within ninety days of the January 9, 1997 demand letters,L yOh- x,ԍSection 76.61(a)(2) provides thirty days in which cable operators may respond to a Section 76.61(a)(1) station  xYmust carry request. Section 76.7(c)(4)(iii) requires that must carry complaints be filed within sixty days of the cable  xoperator's denial of carriage or failure to respond within the thirty day period provided in Section 76.61(a)(2). In  xother words, where no response is filed the complaint must be filed within ninety days from the date of the carriage request.L the complaints were dismissed pursuant to   S-76.7(c)(4)(iii)(B) of the Commission's rules.x yO-ԍHaving resolved the case on these grounds, we did not reach any other issue raised by WJUETV.  S- ` x3.` ` The petitions present no new factual information or other evidentiary matter not previously  xbefore us. The petitions claim error in the finding that WJUETV's letters of January 9, 1997, constituted  x/requests for carriage under Section 76.61(a)(1). It claims that those letters and other correspondence  xbetween the parties show that, rather than demanding carriage, WJUETV and the cable operators were  xattempting to negotiate carriage arrangements. WJUETV argues that Horizon denied carriage in its  xApril18, 1997 letter, that Cablevision denied carriage in its April 28, 1997 letter, and that therefore the  x>complaints, which were filed on June 6, 1997 were timely filed within sixty days of those denials, as  xrequired by Section 76.7(c)(4)(iii)(B). These arguments are not supported by new evidence which  SH - xypersuades us that our underlying decisions in Horizon I and Horizon IIqH  {O-ԍSee Horizon I,  3 & 6; see also Horizon II,  45 & 8.q were in error. In those decisions  xjwe examined the correspondence to which WJUETV points and found that WJUETV made an obvious  S -request for carriage in its January 9, 1997 letters.g  {O4-ԍSee Horizon I,  6; see also Horizon II,  8.g  S -1 ORDERING CLAUSES  S -  SZ-  ?x4.
