This adjustment reduced Operator's maximum permitted rate ("MPR") from $9.71 to $9.64. S- ` Ax5.` ` Upon review of Operator's FCC Form 1210 for the period April 1, 1994 to December 31, xj1994, we have adjusted Module A, Line A1 to reflect Operator's previous MPR of $9.64. Also, we have",p(p(88" S- xcorrected Operator's Module I, Line I5 from 1.0515 to 1.0215.|~ {Oh- xԍ Because Operator is a benchmark transition system, Operator's inflation factor was corrected pursuant to Public {O2- x;Notice:Cable Rates Adjustment for Inflation Applied to Transition Rates (DA 952295, released November 9, 1995) x+ ("Public Notice"). The Public Notice requires operators to remove from their rates the any inflation taken incorrectly xpursuant to a prior public notice, released March 8, 1995. Operators were given until March 31, 1996 to remove xthe excess inflation from their CPST rates. In its refund plan, Operator should indicate which part of its overcharges, xJbetween March 23, 1995 and March 31, 1996 is attributable to its excess inflation and deduct that amount from the refunds owed to its CPST subscribers. These adjustments reduced Operator's S- xMPR from $11.10 to $10.80. ~ yO - xԍ Information regarding the specific adjustments made to Operator's FCC Forms can be found in the public files xZfor the abovereferenced community which are available in the Cable Services Bureau's public reference room, or xithrough the Commission's copy contractor, International Transcription Services (ITS), 1231 20th Street, N.W., yO -Washington, DC, 20036, or by calling ITS at (202) 8573800. Because Operator's actual CPST rate of $12.84 exceeds its reduced MPR x=of $10.80, we find Operator's actual CST rate of $12.84, effective March 1, 1995 to June 30, 1995 to be S-unreasonable. ~ yO- xYԍThis finding is based solely on the representations of Operator. Should information come to our attention that x;these representations were materially inaccurate, we reserve the right to take any appropriate action. In addition, we revised Module D to correspond with Module I of Operator's prior FCC Form 1240 xand revised Module F, Line F8 to correspond with the revision made in Operator's prior FCC Form 1240. xFurthermore, we corrected Module I, Line I3 to reflect the movement of two channels from CPST to BST. xThese adjustments reduced Operator's MPR from $14.60 to $12.94.
