TCG requests that we order TU Electric to cease and desist from enforcing the   fee imposed in the 1994 Amendment because the imposition of the fee violates the Commission's holding  S -  in Heritage. TU Electric argues that the 1992 Agreement and the 1994 Amendment are not within the Commission's jurisdiction. We agree with TU Electric.  S-  Q6.` ` Prior to 1996, Section 224 authorized the Commission to adjudicate disputes between   lcable television system operators and telephone and electric utilities concerning alleged unjust and  SF-  -unreasonable pole attachment rates, terms and conditions.;FL D3 yO2#-ԍ 6 FCC Rcd at 7099.; At the time that Heritage was decided, Section  S -  224 applied only to pole attachments made by a cable television system. Heritage is not applicable in this   case because TCG was not a cable operator and was unable to invoke the provisions of Section 224 at the   /time of its agreements. In the Telecommunications Act of 1996 ("1996 Act"), Congress extended the",`(`(88$"  S-  Commission's jurisdiction under Section 224 to include telecommunications providersD3 yOh-  ԍ Section 224(a)(4) now defines pole attachments as "any attachment by a cable television system or provider of telecommunications service." 47 U.S.C. Section 224(a)(4). and instructed the   Commission to promulgate new rules to regulate pole attachment rates charged to telecommunications  S-  carriers." D3 {Op-  >ԍ See 47 U.S.C. Section 224(e). See also, In the Matter of Implementation of Section 703(e) of the   Telecommunications Act of 1996: Amendment of the Commission's Rules and Policies Governing Pole Attachments,   ZFCC 9820, released February 6, 1998. Section 1(44) of the Communications Act defines a telecommunications carrier as "any provider of telecommunications services . . . ." 47 U.S.C. Section 153(44). Until those rules become effective, Congress determined that the current regulations concerning   the "rate for any pole attachment used by a cable television system solely to provide cable services . . .   .shall also apply to the rate for any pole attachment used by a cable operator or any telecommunications  S8-  carrier (to the extent such carrier is not a party to a pole attachment agreement) to provide any  S-telecommunications service" (emphasis added).D D3 yO -ԍ 47 U.S.C Section 224(d)(3).D  S-  B7.` ` The 1996 Act became effective on February 8, 1996. At that time TCG, a provider of   telecommunications services, was a party to a pole attachment agreement (the 1992 Agreement and its   1994 Amendment). Congress excluded from the Commission's jurisdiction telecommunications providers   that were parties to pole attachment agreements as of the effective date of the 1996 Act. Because TCG   was a party to the 1992 Agreement and its 1994 Amendment as of the effective date of the 1996 Act, we   have no jurisdiction over the rates, terms and conditions of the 1992 Agreement and its 1994  S -  Amendment. D3 yO -  Jԍ TU Electric also argues that TCG lacks standing to file a motion for enforcement under Section 1.1412 of the   LCommission's rules, 47 C.F.R. Section 1.1412. Section 1.1412 "contemplates the use of Section 312 [of the   Communications Act, 47 U.S.C. Section 312] hearings with respect to ceaseanddesist orders . . . regarding the  {Ob-  X regulation of pole attachments." In the Matter of Implementation of the Telecommunications Act of 1996, Amendment  {O,-  Jof Rules Governing Procedures to be Followed When Formal Complaints Are Filed Against Common Carriers, FCC   96460, released November 27, 1996 at par. 60. Section 1.1412 states that "[i]f the respondent fails to obey any   order imposed under this subpart, the Commission on its own motion or by motion of the complainant may order   the respondent to show cause why it should not cease and desist from violating the Commission's order." We note   that TCG has not filed a complaint pursuant to Section 1.1404 of the Commission's rules (47 C.F.R. Section 1.1404)   and, consequently, no order has been issued in which TCG was the complainant. Therefore, TCG has no standing to bring an action against TU Electric under Section 1.1412.  While TCG acknowledges that Section 224, as amended by the 1996 Act, "excludes   telecommunications carriers who are a party to a pole attachment agreement, [TCG states that it] does not   [fall within that provision since its pole attachment agreement with TU Electric is void and unenforceable  SX-  by its own terms."6XD3 yO!-ԍ Motion at 12.6 TCG maintains that its pole attachment agreement with TU Electric is unenforceable   because the additional surcharge, added by the 1994 Amendment, is an illegal provision which is  S-  yunenforceable under Section 224 and Heritage.6D3 yO6%-ԍ Motion at 11.6 TCG's assertions do not persuade us. As stated above,  S-  !Heritage may only be applied by those agreements which are protected under Section 224 of the  S-  Communications Act. Therefore, Heritage does not cause TCG's pole attachment agreement with TU",`(`(88"   Electric to be void or unenforceable. The 1992 Agreement, and its 1994 Amendment, because they   lconcern a utility and a telecommunications provider, and were in effect prior to February 8, 1996,   comprise the type of agreement specifically excluded by Congress in Section 224, as amended by the 1996   .Act. Because Congress has explicitly limited our jurisdiction by excluding this type of pole attachment  S`-agreement from Section 224, as amended by the 1996 Act, we must dismiss TCG's Motion.  S- IV.
