("Phoenix") in the communities of Eutawville,  S@-Holly Hill, and Orangeville, South Carolina@r yO-  ԍWQHB identified the community unit identifiers ("CUIDs") for the city of Eutawville (SC0442), Holly Hill  yOp-(SC0239), and Orangeville (SC0441). hh, (the "Communities"). Phoenix did not file a response.  S- II.BACKGROUND  S-  2.` ` Pursuant to Section 614 of the Communications Act and implementing rules adopted by  Sx-  the Commission in its Report and Order in MM Docket 92259,x r {O8-#X\  P6G;IP#Ѝ8 FCC Rcd 2965, 29762977 (1993) ("Must Carry Order"). commercial television broadcast stations   are entitled to assert mandatory carriage rights on cable systems located within the station's market. A   station's market for this purpose is its "area of dominant influence," or ADI, as defined by the Arbitron  S-  audience research organization.{r yOT!-  #X\  P6G;IP#эSection 614(h)(1)(C) of the Communications Act, as amended by the Telecommunications Act of 1996, provides   that a station's market shall be determined by the Commission by regulation or order using, where available,  {O"-  commercial publications which delineate television markets based on viewing patterns. See 47 U.S.C. 534(h)(1)(C).   Section 76.55(e)(1) of the Commission's Rules provides that a commercial television station's market shall be defined   =as its ADI and that the ADIs to be used for purposes of implementing the mandatory carriage rules are those  {O>%-published in Arbitron's 19911992 Television Market Guide. See 47 C.F.R.  76.55(h)(1) (1996).{ An ADI is a geographic market designation that defines each television market exclusive of others, based on measured viewing. ". ,**88"Ԍ S- 8III.SUMMARY OF ARGUMENTS  S-  3.` ` WQHB states that it is a qualified local commercial station assigned to the Columbia,   South Carolina ADI. WQHB further states that the communities served by Phoenix in this instance are   j x$P 8 x$P also located in the Columbia, South Carolina ADI. WQHB further states that, by letter dated September   22, 1997, it requested mandatory carriage on Phoenix's cable system serving the Communities to which  S-  /Phoenix responded on October 17, 1997.6 yOx-ԍPetition at 2.6 In its response, Phoenix stated that it would begin testing  S-  WQHB's signal shortly.?X {O -ԍId. at Exhibit C.? WQHB maintains that Phoenix did not begin testing WQHB's signal and on,  S-  November 6, 1997, WQHB sent a second request to Phoenix for mandatory carriage of its signal.! yOJ -  ԍWQHB states that on November 5, 1997, Phoenix orally informed WQHB that it had not begun testing of  {O -WQHB's signal but that it would begin testing would begin during the second week of November, 1997. Id. at 2. ! By   letter dated November 19, 1997, Phoenix informed WQHB, a UPN affiliate, that its request for carriage   was denied because Phoenix already carried the signal of another local UPN affiliate, WMMP(TV)  SH -  ("WMMP").>H D yO,-ԍPetition at Exhibit E.> Phoenix stated that pursuant to the Commission's network nonduplication rules, it was not   {required to carry the signals of more than one affiliate of the same network. WQHB responded to   kPhoenix's denial of carriage in a letter dated November 25, 1997 which disputed Phoenix's application   =of the Commission's network nonduplication rules to a television station which was not assigned to the   /same ADI as Phoenix and reasserted WQHB's right to mandatory carriage on Phoenix's cable system  S -serving the Communities.7  {O-ԍId. at 3.7  S0- IV.DISCUSSION  S-  4.` ` We will grant WQHB's carriage complaint against Phoenix. Section 614(a) of the   LCommunications Act states that each cable operator shall carry the signals of local commercial television  S-  Lstations.] f  yO-ԍCommunications Act 614(a), 47 U.S.C.  534(a).] A local commercial television station is defined as any full power broadcast television station  Sh-  that is within the same television market as the cable system.1 h  {O-ԍId.1 It is undisputed that WQHB and Phoenix   are located within the same ADI. A cable operator is required to carry the signals of a local commercial   station unless that station fails to deliver a good quality signal to the cable system's principal headend;   [the station's signal substantially duplicates the signal of another local commercial station which is carried   on the system; or the cable operator (with a system of more than 12 usable activated channels) has already   mallocated up to onethird of the aggregate number of its usable activated channels to other local  Sx-  commercial stations.] x  {O&-ԍSee Clarification Order, 8 FCC Rcd 4142 (1993).] The Commission's rules also require a local commercial station that believes that"x ,`(`(88"  S-  a cable operator has failed to meet its carriage obligations to complain in writing to the operator.N  {Oh-ԍSee 47 C.F.R.  76.61 (a)(2).N The   cable operator must respond in writing to the station's complaint within 30 days of receipt. The cable  S-  operator must either commence carriage of the signal or explain its reasons for failing to do so. Z {O-  ԍSee 47 C.F.R. 76.61 (a)(2). If a refusal to carriage is based on the station's distance from the cable system's   jprincipal headend, the operator's response must include the location of the cable system's headend. If a cable   hoperator denies carriage on the basis of the failure of the station to deliver a good quality signal at the cable system's   principal headend, the operator must provide a list of equipment used to make the measurements, the point of measurement and a list of the reception and overtheair signal processing equipment used. If the   Commission determines that a cable operator has failed to meet its mustcarry obligations, it may order an operator to commence carriage of the station in question.  S-  5.` ` As an initial matter, we find that WQHB apparently meets all the requirements to be   /considered a mustcarry station. We further find that the event which triggers the time within which   WQHB was required to file a complaint with the Commission is Phoenix's letter of November 19, 1997  S-  in which Phoenix denies WQHB's request for carriage.EX  yOD-  ԍPhoenix's initial response to WQHB's carriage request, dated October 22, 1997 stated only that it would begin   testing of WQHB's signal. WQHB states that it provided information to Phoenix regarding whom to contact for technical issues. Petition at 3. E WQHB filed its petition on December 5, 1997  Sp-  .and thus WQHB's petition was timely filed. Section 76.56(b)(5) of the Commission's rulesBp,  yO<-ԍ47 C.F.R. 76.56(b)(5).B states that   a cable operator is not required to carry the signals of more than one local commercial television station  S -  Mthat is affiliated with a particular broadcast network.   yO|-  <ԍFor purposes of the mustcarry rules, a broadcast network is an entity that offers programming on a regular basis for 15 or more hours per week to at least 25 affiliates in 10 or more states. 47 C.F.R. 76.55(f).  A television station, in order to be considered  S -  y"local," must be assigned to the same television market as the cable system at issue.?  yO-ԍ47 C.F.R. 76.55(c).? In the instant case,   Lboth WQHB and WMMP are affiliates of the UPN network. WQHB however is in the same Columbia,   South Carolina ADI as Phoenix while WMMP is assigned to a different ADI, namely, the Charleston,   South Carolina ADI. As a result, we find that WMMP is not deemed to be a "local" station with respect   [to carriage rights on Phoenix's cable system. We further find that Phoenix's denial of carriage based upon   the Commission's network nonduplication rules is without merit. The Commission's network   znonduplication rules merely require a cable operator to black out network programming from a from a  S-  distant television station when a local television station has exclusive rights to the same programming.= yO$"-ԍ47 C.F.R.  76.92.=   LThe network nonduplication rules do not preclude the carriage of any television station. Consequently,   /the Commission's network nonduplication rules have no application to a station's mustcarry status.   Accordingly, we will order Phoenix to commence carriage of WQHB's signal on its cable system serving the Communities.
