SP- B.` ` Local Service to Communities  S-  Q38.` ` Statutory factor two is "whether the television station provides coverage or other local  S-  .service to such community.". {O$-#X\  P6G;P#эId. at Section 614(h)(i)(C)(ii)(II), 47 U.S.C. 534 (H)(1)(c)(ii)(II). This factor incorporates both technical service and programming service.  S-  .With respect to technical service, the Commission has stated in its Report and Order in MM Docket 92 S-  259 that "to show that the station provides coverage or other local service to the cable communities,   {parties may demonstrate that the station places at least a Grade B coverage contour over the cable"d .,`(`(88"  S-  community or is located close to the community in terms of mileage."f/ yOh-#X\  P6G;P#э8 FCC Rcd at 29762977.f WBSV, according to the Grade   B contour map on file with the Commission, places a Grade B contour over the communities of North   Fort Myers, Sun City and Wimauma. The remaining cable communities are located outside of WBSV's  S- d(#Grade B contour, unlike DeSoto I where all the communities at issue were within WBSV's Grade B contour.  S- 39.` ` The scope of a local station's market may be measured through geographic means by  d(#examining the geographic distance between the station at issue and the relevant cable communities. We  d(#note that the communities are located, on average, 47 miles from WBSV's transmitter site. We find that  d(#WBSV's transmitter site cannot be considered closely proximate to the Communities. We further note  d(#that the oppositions claim that there are certain waterways which act as natural boundaries between the  d(#Communities and WBSV. These waterways include Charlotte Harbor and the Caloosahatchee River. We  d(#[note that natural boundaries indicate the logical scope of an economic market. We thus conclude that the  d(#topography and the distance involved between WBSV and the Communities are some evidence that WBSV and the Communities do not form a single economic market.  S - 40.` ` With respect to programming service, WBSV asserts that in addition to its syndicated  d(#kprogramming, it airs sports programming which is of interest to residents of the Communities. While  d(#WBSV provides evidence of some sports programming, WBVS does not show that it airs programming that is targeted to the specific interests of residents of the Communities.  S-  C.` ` Coverage of News, Sporting Events, or Other Events of Interest by Other Stations  S-Entitled to Carriage  SB-  41.` ` Statutory factor three is "whether any other television station that is eligible to be carried  d(#by a cable system in such a community in fulfillment of the requirements of this section provides news  d(#coverage of issues of concern to such community or provides carriage or coverage of sporting and other  S- d(#events of interest to the community."0X yO-#X\  P6G;P#эSection 614(h)(1)(C)(ii)(III);47 U.S.C.534(h)(1)(C)(ii)(III). We do not believe that Congress intended this third criterion to  d(#Noperate as a bar to a station's ADI claim whenever it could be shown that other stations serve the  d(#Mcommunities at issue. This factor is given greater weight where a cable operator is seeking to delete a  d(#station's mandatory carriage rights in certain communities and it is clear that the station is not providing  d(#local service to those communities. In this case, WBSV seeks to add communities served by, among  d(#others, Jones' and CableVision's cable systems. Jones and CableVision each carries local television  S- d(#=stations serving the interests of the communities which WBSV seeks to add.y1 {Ob!-#C\  P6QP#эSee  12 and 17, supra.y We find that coverage by  d(#other stations is not decisionally significant in those communities where WBSV provides Grade B contour  d(# coverage, however such coverage in the remaining cable communities where WBSV provides no local service weighs against the requested action. ": z1,`(`(88 "Ԍ S- F$-J  F$-J   D.` ` Station Audience  S- 42.` ` Statutory factor four is "evidence of viewing patterns in cable and noncable households  S- d(#[within the areas served by the cable system or systems in such community."2 {O-#X\  P6G;P#эId. at Section 614(h)(1)(C)(ii)(IV); 47 U.S.C. 534(h)(1)(C)(ii)(IV). The record indicates that  d(# F$-J  F$-J WBSV has no measurable audience in the Communities. We note that WBSV has introduced evidence  S8- d(#zthat it is included in television listings such as the NewsPress TeleView along with stations which are  S- d(#!licensed in the Tampa and Fort Myers/Naples areas.y3Z {O -#X\  P6G;P#эSee Consolidated Reply at Exhibit 5.y We further note that the Commission has  S- d(#recognized that stations can take up to three years to establish viewing patterns.4 {Ov - d(##X\  P6G;P#эSee Cable TV Fund 14A, Ltd. d/b/a/ Jones Intercable, Inc., DA 972237 (Cab. Serv. Bur. rel. Oct. 23, 1997) at  17. WBSV has been  d(#.broadcasting for at least twice that length of time and has not garnered a measurable audience during that  d(#ytime. We note that WBSV does not claim that it is a specialty station that attracts a limited audience and  d(#/that is entitled to consideration as a valuable source of diverse programming. Thus we find that this factor weighs against the requested action.  S - E .` ` Supplemental Issues  S - 43.` ` With regard to the supplemental pleadings, we find that WBSV's Consolidated Reply  d(#responded to issues raised in the oppositions and thus was proper under Section 1.45(b) of the  SZ- d(#Commission's rules.f5ZF yO@-#C\  P6QP#э47 C.F.R.  1.45(b).f As a result, we deny WFLA's Motion To Strike WBSV's reply. With regard to  d(#=WINK's comments concerning the manner in which WBSV conducted its signal strength study, we agree  d(#that WBSV has not complied with Commission requirements for Grade B contour showings found in Part  S- d(#=73 of the Commission's rules.l6 yOX-#C\  P6QP#э47 C.F.R.  73.684 et seq.l For determination of WBSV's Grade B contour coverage, we have relied  d(#on WBSV's Grade B contour map on file with the Commission which was submitted as part of the record in this case.  SB- F.` ` Summary  S- ~44.` ` We have carefully considered each statutory and other relevant factors in the context of  d(#=the circumstances presented here. We are under no obligation to give particular weight to any one of the  S- d(#several factors under consideration.+7$f  {O"- d(##C\  P6QP##X\  P6G;P#эSee Time Warner Entertainment Co. FCC, 56 F.3d 151, 175 (D.C. Cir. 1995); accord, Omnipoint Corp. v.  {Or#- d(#FCC, 78 F.3d 620, 633634 (D.C. Cir. 1996) (When Congress directs an agency to consider certain factors, the  d(#iagency simply "must reach an express and considered conclusion about the bearing of a factor, but is not required to give any specific weight to it.").+ We have relied on local service, historic carriage in nearby  d(#\communities, and other relevant factors to find for the requested action in communities where WBSV  d(#provides Grade B contour coverage. We have also taken into consideration the respective DMA  S*- d(#Massignments of the Communities. We note that the communities which we add to WBSV's television"* R 7,`(`(88"  d(#>market are located in Lee and Hillsborough Counties. We further note that those Counties have been  S- d(#assigned to the same DMA TampaSt. Petersburg as WBSV's city of license.t8 O@<ԍ#X\  P6G;P#See  18, supra.t The communities  d(#which we have determined are not part of WBSV's television market are located in counties which have  d(#been assigned to the Fort Myers/Naples DMA. We find that, with regard to those communities which we  d(#decline to add to WBSV's market, the lack of historical carriage and the absence of a measurable  d(#zaudience, where the station has been ontheair for at least six years, is of evidential significance when  d(#linked with other information regarding the market, including the lack of Grade B contour coverage and the evidence of market boundaries.
