The  xfiling of a valid complaint under the 1992 Cable Act triggered an obligation on behalf of the cable  S- xoperator to file a justification of its CPST rates.MX1> yO-Ѝ 47 C.F.R. Section 76.956.M The Telecommunications Act of 1996 ("1996 Act")1> {O-Ѝ Pub. L. 104104, 110 Stat. 56 (Feb. 8, 1996), codified at 47 U.S.C.  151 et seq. and  S`- xyour rules implementing the new legislation ("Interim Rules"),`z1> {Oz - xЍ Implementation of Cable Act Reform Provisions of the Telecommunications Act of 1996, 11 FCC Rcd. 5937 (1996). require that complaints against CPST rates  xbe filed with the Commission by a local franchising authority ("LFA") that has received subscriber  xMcomplaints. An LFA may not file a CPST rate complaint unless it receives more than one subscriber  S- xcomplaint within 90 days after such increase becomes effective.R1> yO\-Ѝ 47 C.F.R.  76.1402 (1966).R Under both the 1992 Cable Act and the  x[1996 Act, if the Commission finds the rate to be unreasonable, it shall determine the correct rate and any  S-refund liability.]d 1> {O-Ѝ  See 47 C.F.R. Section 76.957.]  SH - ` Rx3.` ` The Commission's original rate regulations took effect on September 1, 1993. Section 76.922(b)(6); see Second Order on Reconsideration, supra at 4183, paras. 135138; supra  {O- xat 4190, n.136; see also Public Notice "Questions and Answers on Cable Television Rate Regulation" (April 26, 1994).V Cable operators may also justify rate increases based on the addition and deletion of channels,  S - xzchanges in certain external costs, and inflation, by filing FCC Form 1210.P 1> yO!-Ѝ 47 C.F.R. Section 76.922(d).P An FCC Form 1210 must  xbe filed at least 30 days before new rates are scheduled to go into effect where the Commission has found  xthe cable programming service rate to be unreasonable less than one year prior to the filing, or where there"X, 0*%%ZZx"  S- x[is a pending complaint against the CPST rate.S 1> yOh-Ѝ 47 C.F.R. Section 76.960.S Operators may alternatively justify adjustments to their  xrates on an annual basis using FCC Form 1240 to reflect reasonably certain and quantifiable changes in  xexternal costs, inflation, and the number of regulated channels that are projected for the twelve months  S- xMfollowing the rate change.PX1> yO-Ѝ 47 C.F.R. Section 76.922(e).P Any incurred cost that is not projected may be accrued with interest and  S`-added to rates at a later time.3`1> {O-ԍ Id.3  S- ` x4.` ` On June 13, 1997, Operator filed a Motion to Dismiss the complaints filed by John C.  S- x.Lenoir, dated February 25, 1995 and Ardis Nash, dated August 22, 1995.z1> {O - xЍ See Letter, dated June 12, 1997, from Ernest A. Pighini, Director of Accounting, Comcast Cable Communication's, Inc., to FCC Staff, Mr. Patrick Boateng in response to a Request for Cable Rate Approval.  Operator asserts that it was  xMnever served a copy of the complaints from the complainants and therefore the complaints should be  x-dismissed. Operator's assertions do not persuade us that the complaints are invalid or should be dismissed.  xThe complainants certified on FCC Forms 329 that they mailed copies to Operator on February 25, 1994  xand August 22, 1995. Although Operator asserts that it did not receive copies of the complaints at those  S - x[times, under our rules service is complete upon mailing. 1> yP-Ѝ#c PE37 P# 47 C.F.R.  76.956(a). # Xw PE37 =9XP#ќ Therefore, we will deny Operator's Motion to Dismiss.  S - ` x5.` ` Upon review of Operator's FCC Form 393 for CUID No. MI0560 and FCC Forms 1200  xand FCC Forms 1210 for both CUID No. MI0996 and MI0560, we find the Operator has justified its  x[CPST rates for the period September 1, 1993 to October 31, 1996 for CUID No MI0560 and from May 15, 1994 to October 31, 1996 for CUID No. MI0996.  S- ` 3x6.` ` Upon review of Operator's FCC Forms 1240 for the projected period from November  xy1, 1996 to October 31, 1997, we find that Operator has justified its MPR of $12.43 in both communities  xreferenced above. Therefore, we find that Operator's actual CPST rate of $12.43, effective November  Sh-1, 1996 in the abovereferenced communities is not unreasonable. he 1> yOm- xЍ The findings herein are based solely on the representations of Operator. Should information come to our  xattention that these representations were materially inaccurate, we reserve the right to take appropriate action. This  x=Order is not to be construed as a finding that we have accepted as correct any specific entry, explanation, or argument made by any party to this proceeding not specifically addressed herein.  S- ` x7.` ` Accordingly, IT IS ORDERED, pursuant to Section 0.321 of the Commission's rules, 47  xjC.F.R.  0.321, that the monthly CPST rates effective September 1, 1993 to October 31, 1996 for CUID  x|No. MI0560 and from May 15, 1994 to October 31, 1996 for CUID No. MI0996, ARE NOT UNREASONABLE."M 0*%%ZZ"Ԍ S- ` ԙx8.` ` IT IS FURTHER ORDERED, pursuant to Section 0.321 of the Commission's rules, 47  xC.F.R.  0.321, that the monthly CPST rate of $12.43 charged by Operator in the communities referenced above, effective November 1, 1996, IS NOT UNREASONABLE. Section 0.321, that the Motion to Dismiss the complaints filed against the CPST rates charged by Operator in the community referenced above, IS DENIED.
