The City further argues that it qualifies as a "small cable operator" or a  S- x"small cable company," pursuant to the Act and the Commission's rules.m N } yO$-ԍ The City cites 47 U.S.C. 543(m)(2) and 47 C.F.R. 76.901(e).m The City contends that Fal xyComm's initial petition was procedurally defective and should have been dismissed. The City states that  xFalComm never served a copy of its initial petition upon the City. We note, too, that the "small cable operator" exemption cited by the  xCity is by its own terms specifically limited to the provisions of 623(a)(c) and (m) of the  SZ- xMCommunications Act which are not applicable in this instance.HZ( } yO"-ԍ 47 U.S.C. 543(a)(c), (m).H Though the City contends that Fal xComm's petition should be dismissed because FalComm neither served its petition on the City nor  xcertified its service, we note that FalComm's petition indicated that a copy had been sent to the City. In any event, we note that the City has not been prejudiced  xin view of our consideration of the City's petition for reconsideration.
