Commission's rules also provide for a refund liability deferral period, if timely  x=requested by Operator, beginning May 15, 1994 and ending July 14, 1994, for any overcharges resulting  S- xfrom Operator's calculation of a new maximum permitted rate ("MPR") on FCC Form 1200.VL {Ox$-ԍ See 47 C.F.R. Section 76.922(b)(6)(ii).V This  xdeferral of refund liability, however, does not apply to refund liability that may have occurred because  xMOperator's March 31, 1994 rates for its CPST subject to regulation were higher than levels permitted"b,N(N(ZZ "  S- xunder the Commission's rules in effect before May 15, 1994.2L {Oh-ԍ Id.2 Accordingly, while the liability period for  x/Operator's overcharges associated with its FCC Form 1200 filing may not begin to run until July 15,  x1994, Operator will incur refund liability between May 15, 1994 and July 14, 1994 for any CPST rates  S-charged above the MPR approved by the Commission on Operator's FCC Form 393.2ZL {O-ԍ Id.2  S8- ` x5.` ` Upon review of Operator's FCC Form 393 we find that Operator has justified its CPST rates effective September 1, 1993 through July 13, 1994.  S- ` x6.` ` Upon review of Operator's FCC Form 1200 we find no apparent errors in Operator's  xzcalculation of its MPR of $3.14. However, because Operator's actual rate of $4.54, effective July 14,  x1994, was more than its MPR of $3.14, we find Operator's CPST rate for the period July 14, 1994 through December 31, 1994, to be unreasonable.  S - ` Ax7.` ` Upon review of Operator's FCC Form 1210 for the period April 1, 1994 to December 31,  x1994, we find no apparent errors in Operator's calculation of its MPR of $3.42. However, because  xOperator's actual rate of $4.54 was more than its MPR of $3.42, effective January 1, 1995, we find Operator's CPST rate for the period January 1, 1995 through December 31, 1995, to be unreasonable.  S0- ` x8.` ` Upon review of Operator's FCC Form 1210 for the period January 1, 1995 to December  x31, 1995, we find no apparent errors in Operator's calculation of its MPR of $3.75. However, because  xOperator's actual rate of $4.54 was more than its MPR of $3.75, effective January 1, 1996, we find Operator's CPST rate for the period January 1, 1996 through September 30, 1996, to be unreasonable.  Sh- ` x9.` ` Upon review of Operator's FCC Form 1240 for the projected period October 1, 1996  xthrough September 30, 1997, we find Operator's MPR of $5.17 to be reasonable. Because Operator's  xactual CPST rate of $5.17, effective October 1, 1996, does not exceed its MPR, we find Operator's actual  S-CPST rate of $5.17, effective October 1, 1996 through the present, to be reasonable.
