In   any event, we need not reach the issue, because we believe that a waiver of the crossownership rules is  S-appropriate in this instance.   yO>-  ,ԍ Accordingly, we reach no conclusion as to whether the University's video distribution system is a cable system under the statute and our rules.  S-ll U  S-6.` ` The Commission's crossownership rule 47 C.F.R.  76.501(a)w \ yOF"-  ԍSection 613 of the Communications Policy Act of 1984 (47 U.S.C. 533) which acts as the statutory basis for  {O#-  the cable televisionbroadcast station crossownership ban, was modeled after Section 76.501(a).  In Re Kilgore Cable  {O#-TV Company, 11 FCC Rcd 1684 (1996). w reads in relevant part:  `XNo cable television system . . . shall carry the signal of any television broadcast station  if such a system directly or indirectly owns, operates, controls, or has an interest in a TV  Qbroadcast station whose predicted grade B contour . . . overlaps in whole or in part the": ,-(-(ZZC" service area of such system . . .    [The policy goals of Section 76.501(a) are to increase competition in the economic marketplace and in the  S-  marketplace of ideas.e  {O-ԍ In Re Kilgore Cable TV Company, 11 FCC Rcd at 5. e In cases where enforcement of the ban on crossownership does not promote these  S`-goals, a waiver of these rules will be entertained by the Commission.  \`Z {OZ-  ԍ Id., In Re Cablevision of Augusta, Inc., 62 FCC 2d 184 (1977), citing Second Report and Order, Docket  {O$-18397, 23 FCC 2d 816, 821 (1970), recon. denied, 39 FCC 2d 377 (1973).    S-  ~7.` ` In the instant case, we believe the stated policy objectives of the crossownership rules   would not be impaired by granting a waiver and allowing the University to simultaneously own and   operate a broadcast station and campus video distribution system. With regard to economic competition,   the University contends that waiving the crossownership restrictions would have no adverse impact in the   Tucson media market. The University's two public television stations are noncommercial. As such, they   do not compete economically with the other broadcast stations in the same market. Thus, the University   =does not have the same incentives to engage in anti-competitive conduct as a commercial operator might,   since its broadcast channel does not compete with the other local broadcast channels for advertising   <revenue. Accordingly, waiver of the television cable crossownership rule is particularly appropriate where   the television stations involved are noncommercial, because "they are not engaged in economic  S -  competition visavis other media" in the area the cable system will serve.r ~ {O-ԍIn Re Applications of All Clear Cable TV, 50 FCC 2d 693, 694 (1975).r Furthermore, the University's   video distribution system will not be available outside of the confines of the University. This limits substantially the potential to undermine competition of media services in the Tucson market.  S-  8.` ` Operation of the facility in question would have the beneficial effect of increasing   programming choices available to students residing on campus. The University video distribution system   >enables students to receive instructional and educational programming, in addition to all local Tucson   broadcast stations. This video distribution system, moreover, ensures a clear reception of all channels  S@-  which is virtually impossible in the student rooms at present.X@ yO-  ԍDue to the construction of the University's buildings, reception of local television broadcast stations over the   iair is virtually impossible without a rooftop antenna. Although such rooftop antennas were installed they only  yO-service limited areas, not to include student rooms.   Moreover the facility functions as a   integral internal part of the University's education function with the students being the primary   kbeneficiaries of the video distribution system.
