XxX` ` `  S- ` x5.` ` Falcon asserts that Rio Virgin offers comparable programming Xg yO- x[ԍThe Commission observed that Congress specified a definition of comparable programming for the LEC  xYeffective competition test different from that adopted for the first three effective competition tests enacted as part  xof the 1992 Cable Act. The Commission determined that on an interim basis it will apply this new comparable  xiprogramming standard which "includes access to at least 12 channels of programming, at least some of which are  {O - xYtelevision broadcasting signals" to the LEC effective competition test. See Cable Act Reform Order at 12 (quoting 1996 Act Conference Report, S. Rep. 104230 at 170 (Feb. 1, 1996)). to Mesquite subscribers.  xSpecifically, Falcon has submitted Rio Virgin's current channel lineup that offers over 58 channels,  xincluding numerous local television broadcast stations and nonbroadcast programming services. Falcon offers nearly 62 channels of programming on its Mesquite cable system. x  S-"A III. ANALYSIS ĐTP  Sp- ` x6.` ` As defined in the Communications Act, cable systems are presumed not to be subject to  SH - xeffective competition.= H g yO-ԍ47 C.F.R. 76.906.= The cable operator carries the burden of providing sufficient evidence to  xdemonstrate that effective competition, as defined by Section 76.905 of the Commission's rules, is present  S -in the franchise area.C b g yO-ԍ47 C.F.R. 76.911(b)(1).C We find that Falcon has met this burden.  S - ` Ax7.` ` With regard to the first part of the LEC effective competition test, which requires that the  xalleged competitive service be provided by a LEC or its affiliate (or any multichannel video programming  xdistributor ("MVPD") using the facilities of such LEC or its affiliate), we find that Falcon has provided  xsufficient evidence demonstrating that: 1) Rio Virgin meets the Commission's definition of MVPD; and  S- xy2) Rio Virgin also is an affiliate of Rio Virgin Telephone, a LEC as defined by the Communications Act.Z@ g yO-ԍThe Communications Act defines the term "local exchange carrier" as:  ` pXxX` ` any person that is engaged in the provision of telephone exchange service or exchange  ` paccess. Such term does not include a person insofar as such person is engaged in the  ` p3provision of a commercial mobile service under Section 332(c), except to the extent that the Commission finds that such service should be included in the definition of such term. ` Communications Act 3(26), 47 U.S.C. 153(26).Z  xWe conclude that Falcon satisfies the affiliation prong of the LEC effective competition test. Furthermore, Falcon is unaffiliated with either Rio Virgin or Rio Virgin Telephone.  Sh- ` x8.` ` We also find that Falcon has submitted sufficient evidence to show that the programming  xof Rio Virgin is comparable to that provided by Falcon. The channel information for Rio Virgin  xsubmitted by Falcon establishes that Rio Virgin offers 58 channels of programming, including broadcast",>(>(IID" and nonbroadcast channels.  S- ` x9.` ` In addition, we find that based on the information before us, Rio Virgin is offering service  xMin Falcon's franchise area sufficient to demonstrate the presence of effective competition. Falcon has  x{stated that its entire franchise area has been overbuilt by Rio Virgin, which has a twenty (20) year  S8- xfranchise commitment to provide video service to the City of Mesquite.8g yO-ԍRio Virgin's franchise is attached as Exhibit B to Falcon's Petition for Special Relief. We note that Rio Virgin's  x?substantial marketing efforts should ensure that potential subscribers are reasonably aware of the  xavailability of Rio Virgin's service. Subscribers in Falcon's franchise area also are able to receive Rio  xVirgin's service for only a minimal additional investment and without regulatory, technical or other  xkimpediments. Therefore, consistent with Congressional intent in adopting Section 623(l)(1)(d) of the Communications Act, we find that effective competition is present.  S -w IV. ORDERING CLAUSES ĐTP  S - ` % x10.` ` Accordingly, IT IS ORDERED that the Petition for Determination of Effective  xCompetition filed by Falcon Cable TV, challenging the certification of the City of Mesquite, in Mesquite,  S -Nevada IS GRANTED.  S0- ` x11.` ` IT IS FURTHER ORDERED that the certification of the City of Mesquite, Nevada to  S-regulate the basic cable rates of Falcon Cable TV in Mesquite, Nevada IS REVOKED .
