The revised schedule  x[also would allow MediaOne to incorporate the results of the Massachusetts Commission's review of the  S8-1996 Form 1240s into its preparation of the 1997 Form 1240s.$8w {O- xJԍTo complete the Form 1240, an operator must first enter information from its previous Form 1240. See FCC Form 1240, Instructions for Module A.  S- ` nx18.` ` Because TCI last implemented Form 1240 rate changes for the affected systems more than  x12 months before MediaOne's proposed July 1, 1997 effective date for the 1997 Form 1240 rate changes,  xthe agreement of MediaOne and the Massachusetts Commission to extend the Form 1240 filing date to May 1, 1997, does not violate our rules and does not require Commission approval. Accordingly, MediaOne may not implement its revised rates less  xthan 90 days after it files its Form 1240s with the Massachusetts Commission unless we grant a waiver  S-of our rules to permit an earlier implementation date./'Dw yO- xԍIn support of its conclusion that its agreement with the Massachusetts Commission does not require Commission  xapproval, MediaOne relies on an August 26, 1994 letter to MediaOne from the Chief of the Cable Services Bureau.  {OF- x-See Continental Cablevision (Letter), 9 FCC Rcd 4453 (Cab. Serv. Bur., 1994). There we approved MediaOne's  x agreement with the Commonwealth of Massachusetts Community Antenna Television Commission to extend the one xyear limit on the payment of refunds attributable to BST overcharges. We concluded that the agreement would  xbenefit subscribers and advised MediaOne that in the future it would not need to obtain Commission approval of  {Oh- xsimilar agreements. Id. at 4453. That ruling is not applicable here. MediaOne's agreement with the Massachusetts Commission involves a procedural filing deadline, not the calculation of refunds. /  S- ` ~x20.` ` MediaOne and the Massachusetts Commission have agreed that MediaOne may file its  xForm 1240s only 60 days before the implementation of any resulting rate change. The 60day time period  xresults from the extension of the filing deadline by two months to May 1, 1997, and from the extension  xkof the implementation date by only one month to July 1, 1997. The effect of these extensions is that  xMediaOne will implement any Form 1240 rate increases one month later than scheduled, but the  xMassachusetts Commission will have less time than our rules allow to complete its review of the Form  x1240s before any resulting rate changes are implemented. To comply with our rules, MediaOne would  xzhave to file its Form 1240 one month earlier than the agreedupon filing date or delay the agreedupon rateeffective date by one month. "P',_(_(II"Ԍ S- ` x21.` ` We grant the necessary waiver of our rules to permit MediaOne and the Massachusetts  x?Commission to implement their agreement.
