                             ORDER

   Adopted:  June 6, 1997               Released:  June 12, 1997 

By the Chief, Financial Analysis and Compliance Division, Cable Services Bureau:

     1.   Here we consider a request to withdraw an FCC Form 329 rate complaint
("complaint").  On April 4, 1997 the Federal Communications Commission ("Commission")
received a letter from the complainant notifying the Commission of his intent to withdraw his
complaint against the cable services programming tier ("CPST") rate charged by the above-
referenced Operator ("Operator").  We will allow the withdrawal of the complaint, and our review
of the resulting rate justifications will therefore be terminated.

     2.  Our mandate is to protect subscribers of any cable system not subject to effective
competition from paying rates higher than those that would be charged if the system were subject
to effective competition.  While our rules forbid collusive agreements between operators and
subscribers regarding forbearance from rate regulation, there is no evidence of such an agreement
here.  We will accordingly allow the complainant to withdraw his complaint.

     3.   Accordingly, IT IS ORDERED, that the request to withdraw the FCC Form 329 rate
complaint against the CPST rate charged by the Operator in the community referenced above IS
GRANTED, and the review of the resulting rate justification filings IS TERMINATED.

     3.   This action is taken pursuant to delegated authority under Section 0.321 of the
Commission's rules, 47 C.F.R.  0.321.
