Because those issues are more properly before us during our resolution of  x{Omnipoint's Complaint, we do not reach the merits of those issues in this Order. We will,  X-however, deny Omnipoint's Request.  X- `  x2.` ` The Commission's established pleading cycle for this type of complaint requires  Xv- xa response within 30 days followed by a reply within 20 days.Lv  yOG -ԍ 47 C.F.R. Omnipoint alleges that the rate that PECO has offered for access to its facilities is hindering  x-Omnipoint's entry into the Philadelphia telecommunications market. Omnipoint asserts that PECO is exerting  x unequal bargaining power which has created an effective barrier to competition under Section 224 of the  xCommunications Act of 1934, as amended. In addition, Omnipoint contends that market entry barriers contradict  xthe procompetitive policies of Congress and the Commission. Moreover, Omnipoint believes that the true victim is the consumer in Philadelphia and thus, it is in the public interest to expedite this matter.  In its Opposition, PECO  xasserts that the Commission's rules relating to pole attachments do not provide for an expedited  xpleading cycle and that Section 1.1407(a) correctly establishes the proper time frames for pole  X -attachment complaint proceedings. @  yO@- xiԍ PECO's Opposition at 2 (citing 47 C.F.R.  1.1407(a)). PECO believes that there is no reason to expedite  xthe time frames in this proceeding because Omnipoint has never indicated when it planned to begin service. In  x,addition, PECO claims to be more than ready to enter into a Master Lease Agreement with Omnipoint. Moreover,  xPECO contends that if Omnipoint enters into an agreement, the Commission's rules allow Omnipoint to recover the  xdifference between PECO's rate and the maximum just and reasonable rate should PECO's rate be found  xunreasonable. PECO also believes that the Commission should not shorten the pleading cycle because this is an  xatypical case concerning a PCS provider who is not requesting traditional pole attachment space on poles, towers and rightsofway in order to install its equipment. In the Interconnection Order, the Commission  xKagreed that "time is of the essence" and that "final decisions related to access will be resolved by  X- x=the Commission expeditiously."O yOa%-ԍ 11 FCC Rcd 15499 at para. 1224 1225.O The Commission concluded that because of the expeditious  xnature of the 45day procedure created for denial of access complaints in the Interconnection  xOrder, "stays or other equitable relief will [not] be granted in the absence of a specific showing,"d,-(-(ZZ"  X- x[beyond the prima facie case that such relief is warranted."I yOy-ԍ 11 FCC Rcd 15499 at par. 1225. I Omnipoint has failed to show that  xLits Complaint requires a more expeditious proceeding than the 45day denial of access process  X- xfound in Section 1.1403(b) of the Commission's rules,MX yO-ԍ 47 C.F.R Section 1.1403(b) (1996). M or the 50day pole attachment complaint process instituted under Section 1.1407. Consequently, Omnipoint's Request must be denied.  X- ` x5.` ` Accordingly, IT IS ORDERED, pursuant to Sections 0.101 and 0.321 of the  x/Commission's rules, 47 C.F.R.  0.101 and 0.321, that Omnipoint Corporation's Request for  X_-Expeditious Action IS DENIED.
