On December 20, 1996, Falcon Cable Systems ("Falcon") filed with the Commission a petition for review of a rate order adopted on November 20, 1996, by the City of Yoncalla, Oregon (the "City"). The City filed its response to the petition for review on January 17, 1997. The rate order established Falcon's rates for basic cable service, equipment, installations and hourly service charges, as authorized by the Cable Television Consumer Protection and Competition Act of 1992 ("1992 Cable Act"). 2. On January 27, 1997, Falcon filed with the Commission a motion to dismiss its earlier-filed appeal. No opposition to the motion has been filed. 3. Accordingly, IT IS ORDERED THAT Falcon's motion to dismiss its appeal of the rate order issued by Yoncalla, Oregon IS GRANTED and the appeal IS DISMISSED. 4.
