T   * * * * *Tx  }[This subsection] establishes certain criteria which the Commission shall consider  Pin acting on requests to modify the geographic area in which stations have signal  carriage rights. These factors are not intended to be exclusive, but may be used  X -to demonstrate that a community is part of a particular station's market.Z  yO7-ԍH.R. Rep. No. 628, 102d Cong., 2d Sess. 97 (1992).Z     X- ` x5.` ` The Commission provided guidance in its Must Carry Order, to aid decision making in these matters, as follows:  aXxFor example, the historical carriage of the station could be illustrated by the  X6- submission of documents listing the cable system's channel lineup (e.g., rate  2cards) for a period of years. To show that the station provides coverage or other  local service to the cable community (factor 2), parties may demonstrate that the  station places at least a Grade B coverage contour over the cable community or  2is located close to the community in terms of mileage. Coverage of news or other  programming of interest to the community could be demonstrated by program logs  or other descriptions of local program offerings. The final factor concerns  X- nviewing patterns in the cable community in cable and noncable homes. Audience  data clearly provide appropriate evidence about this factor. In this regard, we note  }that surveys such as those used to demonstrate significantly viewed status could  be useful. However, since this factor requires us to evaluate viewing on a  ncommunity basis for cable and noncable homes, and significantly viewed surveys  typically measure viewing only in noncable households, such surveys may need  X-to be supplemented with additional data concerning viewing in cable homes.iX {O"-ԍMust Carry Order, 8 FCC Rcd at 2977 (emphasis in original).i   X- ` x6.` ` In adopting rules to implement this provision, the Commission indicated that  xchanges requested should be considered on a communitybycommunity basis rather than on a  xcountybycounty basis and that they should be treated as specific to particular stations rather"!,N(N(ZZ "  X- xthan applicable in common to all stations in the market. Z {Oy- xԍMust Carry Order, 8 FCC Rcd at 2977 n.139. Viewership data cited herein is county data rather than  yOC- xcommunityspecific data. However, absent evidence that such data is not fairly reflective of viewing in the actual communities in question, we accept such data as probative in cases of this type. The rules further provide, in  x[accordance with the requirements of the Act, that a station not be deleted from carriage during  X-the pendency of a market change request.<  yOm-ԍ47 C.F.R. 76.59.<  X- ` x7.` ` Adding communities to a station's market generally entitles that station to insist  xjon cable carriage in those communities. However, this right is subject to several conditions: 1)  x=a cable system operator is generally required to devote no more than onethird of the system's  X_- xactivated channel capacity to compliance with the mandatory signal carriage obligations,N _z {O -ԍSee 47 U.S.C.  534(b)(1)(B).N 2) the  XH- xstation is responsible for delivering a good quality signal to the principal headend of the system,S H  {O-ԍSee 47 U.S.C.  534(h)(1)(B)(iii).S  xand 3) the system operator is not required to carry the signal of any station whose signal  xLsubstantially duplicates the signal of any other local signal carried, or the signals of more than  X - x|one local station affiliated with a particular broadcast network.K   {OR-ԍSee 47 U.S.C.  534(b)(5).K If, pursuant to these  xrequirements, a system operator elects to carry only one such duplicating signal, the operator is  xobliged to carry the station from the ADI whose city of license is closest to the principal  X - xjheadend of the cable system.: 0  yO-ԍ8 FCC Rcd at 2981.: Accordingly, depending upon the circumstances involved, the  xzaddition of communities to a station's market may have the following consequences. It may  X- xguarantee that station's carriage in the subject communities. Should there be more mustcarry  xstations that onethird of the system's channel capacity, it would provide the system operator with  xan expanded list of mustcarry signals from which to choose. Should the station be a duplicating  x[network station, it will determine which station has priority carriage in the subject communities added.  X-V  MARKET FACTS AND ARGUMENT ă  X- ` 3x8.` ` WNALTV, a television station licensed to Gasden, Alabama, is located in the  X- xBirmingham, Alabama ADI, as defined in Arbitron's 19911992 Television ADI Market Guide.g  {O2$-ԍArbitron's 19911992 Television ADI Market Guide, p. 148.g  xWNALTV petitions the Commission to modify the market of its television station to include the  xCommunities served by area cable systems, for purposes of determining statutory mustcarry  xrights. WNALTV asserts that, although the Communities are located in the Anniston, Alabama"~R ,N(N(ZZn"  X- xADI,f {Oy-ԍArbitron's 19911992 Television ADI Market Guide, p. 50.f WNALTV should be entitled to mandatory carriage under the Commission's mustcarry  x/rules on cable systems in those communities. WNALTV stated that the station would, on  xlSeptember 1, 1996, become an affiliate of the CBS television network and that the station  xjbroadcasts programming that fulfills the needs and interests of Anniston and the Communities as well as those of Gasden, its city of license.  Xv- ` x9.` ` WNALTV asserts that the facts and circumstances it has presented show that the  xyCommunities should be included within its market, when considered under the four factors test  xset forth in Section 614(h)(1)(C)(ii) of the Communications Act. First, WNALTV stated that  x{the Time Warner cable system serving the Communities is currently carrying the station.  x>Secondly, WNALTV provided a station signal contour map, which shows that WNALTV  X - xjprovides a Grade A signal over each of the Communities.C Z yO-ԍPetition, Exhibits 2 and 3.C WNALTV further pointed out that  xnone of the Communities is located over thirty miles from Gasden. Thirdly, WNALTV states  xthat it serves as an advertising medium for businesses located in the Communities and often  X - xbroadcasts public service announcements for events and institutions located in the Communities.O  {OY-ԍSee Petition, p. 4 and Exhibit 4.O  Xy- ` #x10.` ` Fourth, WNALTV asserts that it has substantial viewership in the Communities.  x[Such viewership is established, according to WNALTV, by the Nielson 1996 Calhoun County  XK- xMCoverage Study, which shows the station with an average share of four and a cume of 48.OK| {Ox-ԍSee Petition, p. 5 and Exhibit 5.O  xFinally, WNALTV states that Station WJSUTV (Channel 40), which changed its network  xyaffiliation from CBS to ABC on September 1, 1996, is the only station licensed to Anniston. As a result, WNALTV would become the CBS affiliate located closest to the Communities.  X- ANALYSIS AND DECISION ă  X- ` x11.` ` WNALTV has provided sufficient evidence to justify its market modification  xrequest and, accordingly, it will be granted. Considering the information provided for the record  xin light of the factors specified in Section 614(h)(1)(C)(ii) of the Communications Act, we are  xpersuaded that WNALTV's television market should include the Communities. The subject  xCommunities lie in close proximity to station WNALTV. Additionally WNALTV's signal is  xcarried on the cable system serving each of the affected Communities. Further, the fact that  xWNALTV places a Grade A signal over each of the Communities is persuasive evidence that  X - x\the station provides service to these communities.q  {O&-ԍSee Paragon Cable, 10 FCC Rcd 13133, 13137 (Cable Serv. Bur. 1995).q Importantly, too, WNALTV provides" ,N(N(ZZy"  xprogramming specifically designed to serve the interest and needs of the Communities. With an  xlaverage audience share of four and a cume of 48, WNALTV has an established viewing  xaudience in those Communities. We conclude that WNALTV has demonstrated that it is a local  xkstation to and serves the residents of the Communities. Accordingly, the market for station WNALTV will be modified to include the Communities for statutory mustcarry purposes.
