X-  x4.  To justify rates for the period beginning May 15, 1994 through a benchmark or cost  xof service showing, operators must use the FCC Form 1200 series. Cable operators may file a  xFCC Form 1210 to justify rate increases based on the addition and deletion of channels, changes  XH- x[in certain external costs, and inflation.FHx, yOq-ԍ 47 C.F.R. Section 76.922(d).F The Operator must file FCC Form 1210, at least 30 days  xbefore new rates are scheduled to go into effect, where the Commission has found the cable  xprogramming service rate to be unreasonable less than one year prior to the filing, or where there  X -is a pending complaint against the CPST rate.d , {O-ԍ 47 C.F.R. Section 76.960; supra note 12.d  X -  x 5.  Upon review of the record before us, we find that TCI has not justified its  xFebruary1, 1995 CPST rate of $12.53 until April 1, 1995. TCI incorrectly included $.16 per  xmonth for license fees for the first quarter of 1995 in its CPST rates before the end of that  x/quarter. Accordingly, we adjusted TCI's maximum permitted rate to correct this error. As a  Xy- xresult of this adjustment, we have calculated a maximum permitted rate for TCI's CPST of $12.37  xuntil the end of the first quarter. We conclude, therefore, that TCI's CPST rate increase effective  XK- xFebruary 1, 1995 is not justified until April 1, 1995. K, yO- xԍ This finding is based solely on the representations of TCI. Should information come to our attention that these  xrepresentations were materially inaccurate, we reserve the right to take appropriate action. This Order is not to be  xiconstrued as a finding that we have accepted as correct any specific entry, explanation or argument made by any party to this proceeding not specifically addressed herein. However, we determine that the total  X4- xiovercharge per subscriber is de minimis. Therefore, it would not serve the public interest to order a refund.  X-  X-   x6.
