Furthermore, Falcon asserts that the $0.15 rate increase it made in April, 1996  xthat brought the total CPST rate to $1.70 is justified by its June Form 1210. We deny this  xzmotion and find the complaint valid, and for the reasons discussed below, find Falcon's rate increase unjustified.   x7. At the Bureau's request, Falcon filed the June Form 1210 with the Commission to  x/justify the increase in the CPST rate. According to the June Form 1210, Falcon's CPST rate  xprior to the increase under consideration in the instant complaint was $1.55. The June 1210 also  x>reflected a maximum permitted rate calculation of $1.70 per month an increase of $0.15 per month for the CPST.   lx8. To enable the Bureau to perform a complete analysis and resolve discrepancies in the  xLJune Form 1210, on June 28, 1996, the Bureau requested that Falcon provide copies of the FCC  xForms 1200 and 1210 that Falcon had previously filed with the City (the "City Form 1200" and  x"City Form 1210," respectively) which Falcon referenced in the June Form 1210 filing. Falcon  X- xxrefused the Bureau's request. *W yO-#X\  P6G;ɓP#э Pursuant to telephone conversation with Bureau staff on June 28, 1996. Upon Falcon's refusal to provide these documents, Dave Hudson,  xMCorbin's City Manager, provided the Bureau with copies of the City Form 1200 and the City  X|-Form 1210. {|W X - xԍ#X\  P6G;ɓP# The general instructions to the FCC Form 1210 state that all information available on the FCC Form 1210  xxis subject to public inspection and that the information is to be used by the LFA or the Commission to determine  {O"-the reasonableness of a cable company's rates. See Instructions for Filing FCC Form 1210, Page 6, May 1994.""  XN-   x9. The City Form 1210, dated March 9, 1995, reported a maximum permitted rate for the  xCPST of $0.96 (Line K9) with per subscriber external costs at $0.7578 (Line B10). However,  xthe June Form 1210 reports that the permitted rate just prior to the April 1, 1996 increase was  x$1.55 (Line A2). Additionally, the June Form 1210 filing reports the per subscriber external"  ,-(-(ZZy"  xcosts just prior to the April 1, 1996 increase to have been $0.7049 (Lines C15 and H2). We are  xzunable to determine the origin of the claimed prior permitted rate of $1.55, or to reconcile the  xzdifference in the external cost level of the City Form 1210 and that reported in the June Form  x1210. Furthermore, in response to our request for additional information, Falcon did not provide  xa Form 1210 or other documentation to resolve these problems. Therefore, because of  xinsufficient information, we are unable to determine the reasonableness of the rate and deny the rate increase at this time.   p" z *2: "$B')+J.02R57:Z<> Aj  A10. Accordingly, IT IS ORDERED, pursuant to Section 0.321 of the Commission's  x/rules, 47 C.F.R.  0.321, that the complaint referenced herein against the CPST rate increase charged by Falcon in CUID No. KY0078, effective April 1, 1996 IS GRANTED.   11. IT IS FURTHER ORDERED, pursuant to Section 76.961 of the Commission's  xrules, 47 C.F.R.  76.961, that Falcon shall refund to subscribers in the franchise area referenced  xin the caption any increase in CPST rates made effective on April 1, 1996 and billed to subscribers on that date or thereafter.  | 12.
