TriState  x>has shown that Station WINM is licensed to Angola, Indiana, which is in Steuben County,  xIndiana. The Century cable system at issue here serves, and its Huntington headend is located  X9- xin, Huntington County, Indiana.9 {O!-#C\  P6QpP#э See, for example, Rand McNally Commercial Atlas & Marketing Guide, 125th Edition 1994, at p. 164. Both Steuben County and Huntington County, Indiana are in  X"- xthe Fort Wayne ADI."| {OO$-#C\  P6QpP#э See Arbitron's 19911992 Television Market Guide, at p. 502. Because WINM is located in the same ADI as the community served by  xthe cable system on which it seeks carriage, it meets the threshold requirement for mustcarry rights on Century's cable system served by the Huntington headend. ",N(N(ZZ"Ԍ X-  ?x 11. However, as noted earlier, such rights are subject to several conditions, all of which  xwe find that WINM meets. Thus, Century's failure to carry the signal of WINM violates the  xjrequirements of Section 614 of the Communication Act. First, Century makes no argument that  xit is required to devote more than onethird of its activated channels to compliance with this  xmustcarry obligation. Second, Century makes no argument about indemnification for any  xincrease in copyright liability resulting from carriage, or that WINM's signal substantially  x<duplicates that of any other signal carried. Third, we find that WINM, through use of an antenna  xand preamplifier installed at the headend at TriState's cost, can deliver a signal to that headend that substantially exceeds the 45 dBm signal statutory requirement.  X -  x 12. With regard to the use of a preamplifier by WINM, the Commission has stated that  xzamplification equipment may be employed to deliver a good quality signal to a cable system  X - x-headend. When the Commission adopted its Report and Order, it stated that where a signal fails  xlto meet Commission standards, it did not expect the cable operator to bear the burden of  ximproving the signal if the problem resulted from an unsatisfactory local television signal, but it expected the cable operator to cooperate with the television station in resolving the problem: xit is the television station's obligation to bear the costs associated with xdelivering a good quality signal to the system's principal headend. This xmay include improved antennas, increased tower height, microwave relay xequipment, amplification equipment and tests that may be needed to xdetermine whether the station's signal complies with the signal strength xrequirements, especially if the cable system's overtheair reception equipment xis already in place and is operating properly.  X- x(footnote omitted.)d yO<-#C\  P6QpP#э 8 FCC Rcd at 2991. d Clearly this passage finds that where a station has been responsible for the  xcosts of attempting to improve its signal at the cable system's headend, we do not expect the  xstation thereafter to make its signal level measurements before the signal goes through any new  xequipment supplied by the station (such as a preamplifier). Therefore, TriState may make its  xysignal tests at the output of any equipment that it supplies the system. Should WINM's signal  xstill lack sufficient quality or exhibit excessive noise, then the station may need to acquire  xadditional equipment, such as an improved antenna, and take additional signal measurements at  xthe output of this equipment until such time as the station does provide a good quality signal at the system's headend. With regard to the methodology to be employed to determine whether a good quality  xjsignal is delivered to a cable systems headend, 614(h)(1)(B)(iii) of the Communications Act of  x1934, as amended, specifically excludes from the definition of "local commercial station" any  xUHF station which does not provide a minimum signal level, of 45 dBm at the cable system's  xprincipal headend and ". . . which does not agree to be responsible for the costs of delivering to  xthe cable system a signal of good quality or a baseband video signal." In this instance, the data"j$X,N(N(ZZF#"  xsubmitted by Century indicates that WINM's signal strength, when measured after the  X- xpreamplifier, is well above the statutory minimum of 45 dBm.} {Ob-#C\  P6QpP#э See Exhibit A to Century's Opposition.} Century has not otherwise  xdemonstrated that the signal of WINMTV is not of "good quality" such that the carriage  xrequirement is inapplicable.
