						ORDER


Adopted: March 11, 1996			              Released:  March 19, 1996

By the Chief, Consumer Protection and Competition Division, Cable Services Bureau:

	1.	On May 4, 1994, Cable TV of East Providence, Inc. ("Cable TV") filed with the Commission an appeal of the local rate order adopted by the State of Rhode Island and Providence Plantations, Division of Public Utilities, Cable Television Section ("the State") on April 4, 1994.  On May 20, 1994, the State filed its opposition and on June 17, 1994, it filed an erratum.  On June 14, 1995, the Commission adopted an order granting in part and denying in part the appeal of Cable TV. 
  
	2.	 On July 19, 1995, Cable TV filed with the Commission an application for review of the June 14, 1995 Order.  On October 23, 1995, Cable TV filed with the Commission a notice of withdrawal of its application for review.  Cable TV states that it has reached a settlement with the State concerning the rates covered by the Bureau's order adopted on June 14, 1995.  The State was served with the notice of withdrawal, and no opposition has been filed.  Therefore, Cable TV's notice of withdrawal of its application for review is granted.   


3.	Accordingly, IT IS ORDERED THAT Cable TV's notice of withdrawal of its  application for review of the order issued by the Commission for the State of Rhode Island and Providence Plantations, Division of Public Utilities, Cable Television Section, IS GRANTED and the application for review IS DISMISSED.  

	4.	This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules.  47 C.F.R.  0.321 (1993).
