On March 31, 1994, Cablevision Industries Corporation ("CVI") filed with the Commission a notice of appeal of the local rate order adopted by the City of West Columbia, South Carolina ("the City") on March 1, 1994. On April 25, 1994, the City filed an opposition to the appeal. Since neither CVI's notice of appeal nor the City's opposition provided the Commission with sufficient information to determine the merits of the appeal, the Commission allowed the parties to supplement their pleadings. CVI supplemented its appeal on January 23, 1995, and the City supplemented its opposition on February 7, 1995. On September 18, 1995, the Commission adopted an order remanding in part, denying in part and dismissing in part the appeal of CVI. 2. On October 25, 1995, CVI filed with the Commission a petition for reconsideration of the September 18, 1995 Order. On November 20, 1995, CVI filed with the Commission a notice of withdrawal of its petition for reconsideration. CVI states that in reliance on its withdrawal of its petition for reconsideration, the City has not filed an opposition to CVI's petition. In addition, CVI states that the City has reconsidered the record in this matter and has withdrawn its original order, mooting CVI's petition for reconsideration. The City was served with the notice of withdrawal, but no opposition has been filed. Therefore, CVI's notice of withdrawal of its petition for reconsideration is granted. 3. Accordingly, IT IS ORDERED THAT CVI's notice of withdrawal of its petition for reconsideration of the order issued by the Commission for the City of West Columbia, South Carolina, IS GRANTED and the petition for reconsideration IS DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules. 47 C.F.R.  0.321 (1993).
