On January 23, 1994, Apollo Cablevision, Inc. ("Apollo") filed a petition for revocation of certification challenging the certification of the City of Cerritos, California ("Cerritos") to regulate Apollo's basic service rates and associated equipment. On February 16, 1995, Cerritos filed an opposition to Apollo's petition for revocation. On March 6, 1995, Apollo filed a reply to Cerritos' opposition. On March 27, 1995, Cerritos filed a motion to accept supplemental pleading and a supplemental pleading. On May 1, 1995, Apollo filed a response to Cerritos' supplemental pleading. Subsequently, on January 19, 1996, Apollo filed to withdraw its petition for revocation. Apollo states that Cerritos supports Apollo's withdrawal. 2. Accordingly, IT IS ORDERED, pursuant to Section 0.321 of the Commission's rules, 47 C.F.R. 0.321, that the petition for revocation of certification filed by Apollo Cablevision, Inc. with respect to the regulation of basic cable service rates and associated equipment by the City of Cerritos, California IS DISMISSED WITHOUT PREJUDICE.
