On June 16, 1995, Tele-Media Company of Hopewell/Prince George ("Tele-Media"), the operator of a cable television system serving the City of Hopewell, Virginia ("City"), filed with the Commission an appeal of a local rate order adopted by the City on May 18, 1995. The rate order established Tele-Media's rates for basic cable service, equipment, installations and hourly service charges pursuant to the Cable Television Consumer Protection and Competition Act of 1992. 2. On June 26, 1995, the City filed an opposition to Tele-Media's appeal. On July 10, 1995, Tele-Media filed a reply to the Opposition. On December 15, 1995, Tele- Media filed with the Commission a notice of withdrawal to its earlier-filed appeal. Tele- Media states in its withdrawal that the City rescinded its rate order, making Tele-Media's appeal moot. Tele-Media also states that the new reissued rate order by the City is acceptable. No opposition to the notice of withdrawal has been filed. Therefore, Tele- Media's notice of withdrawal of its appeal is granted and its appeal is dismissed as moot. 3. Accordingly, IT IS ORDERED THAT Tele-Media Company's withdrawal of its appeal of the rate order issued by the City of Hopewell, Virginia IS GRANTED and the appeal IS DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules. 47 C.F.R.  0.321 (1993).
