On September 14, 1995, Scripps Howard Cable Company of Northwest Georgia (the "Company"), the operator of a cable television system serving the City of Gordon, Georgia (the "City"), filed with the Commission an appeal of a local rate order adopted by the City on August 15, 1995. The rate order established the Company's rates for basic cable service, equipment, installations and hourly service charges pursuant to the Cable Television Consumer Protection and Competition Act of 1992. The City filed no opposition to the appeal. 2. On November 2, 1995, the Company filed with the Commission a notice of withdrawal to its earlier-filed appeal. The Company states that it and the City have resolved the underlying rate dispute. No opposition to the notice of withdrawal has been filed. Therefore, the Company's notice of withdrawal of its appeal is granted. 3. Accordingly, IT IS ORDERED THAT Scripps Howard Cable Company's withdrawal of its appeal of the rate order issued by the City of Gordon, Georgia IS GRANTED and the appeal IS DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules. 47 C.F.R.  0.321 (1993).
