On May 4, 1995, Prime Cable of Fort Bend, L.P. ("Prime"), the operator of a cable television system serving the City of Pasadena, Texas (the "City"), filed with the Commission an appeal of a local rate order adopted by the City on April 4, 1995. The rate order established Prime's rates for basic cable service, equipment, installations and hourly service charges pursuant to the Cable Television Consumer Protection and Competition Act of 1992. The City filed an opposition on May 25, 1995, and Prime submitted a response on June 5, 1995. 2. On November 3, 1995, Prime filed with the Commission a notice of withdrawal to its earlier-filed appeal. Prime states that the primary ground for its appeal was that the local rate order did not provide an adequate explanation of the City's decision. Subsequently, the City issued an additional order which explains the City's decision, to which Prime does not object, and with which Prime has complied. Therefore, Prime wishes to withdraw its appeal. We will grant its withdrawal. 3. Accordingly, IT IS ORDERED THAT Prime Cable of Fort Bend's withdrawal of its appeal of the rate order issued by the City of Pasadena, Texas IS GRANTED and the appeal IS DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Divison, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules. 47 C.F.R.  0.321 (1993).
