Bur., released June 23, 1995).a In each case, we found that the cable operator could suffer irreparable harm if it were required to comply with the requirements of the Bureau's  YH-refund order during the pendency of its petition for reconsideration or application for review since it appeared that expenditures made in such compliance could be unrecoverable. We also noted that any refunds and adjustments would be due from the release date of the refund order, regardless of any stay of effectiveness, and would include interest amounts, so that no party would be harmed by such a stay. Because the equities justify granting a stay of the order's refund and rate reduction provisions, and no harm results to subscribers or to any other party from such a stay, we found we did not need to reach the question of the likelihood of the operator's success on the merits of the issues raised on reconsideration or application for review. x3. In the instant case, Operators request a stay of the enforcement of the Bureau's rate decision finding the Operators' CPS rate unreasonable, requiring the preparation and implementation of a refund plan and revised FCC Form 1200. Operators request a stay of these decisions pending a final decision by the Commission. Further, TCI Cable Management Corporation ("TCIC"), has asked the Bureau to issue a stay to all similarlysituated TCIC entities where the same issues are presented, including instances where orders have been issued but not yet appealed or where orders are expected to be issued concerning the same issues.
