Here we consider a complaint about the price Star Cable Associates ("Star Cable") was charging for its cable programming service ("CPS") tier in the Township of Nelson, Ohio. Star Cable filed a motion to dismiss the complaint arguing that it is subject to effective competition and thus its cable programming service rate is not subject to regulation  YM-by the Commission.fM^ Y <ԍ #Xw PE37XP#47 C.F.R.  76.905.f Star Cable did not file a rate justification as required by the  Y6-Commission's Rules.6y^ Y`#<ԍ #Xw PE37XP#47 C.F.R.  76.956; see also Cable Operators' Rate Justification Filings, 9 FCC Rcd 7752, para. 3(1) (Cab. Serv. Bur. 1994). x2. The complaint regarding Star Cable's CPS rate for the Township of Nelson was filed with the Commission on September 27, 1993. In response to the complaint, Star Cable filed a motion to dismiss on November 17, 1993.  Y#-  "#0*0*0*%"Ԍ X($- Discussion "($0*0*0*%"Ԍ x3. In its motion to dismiss, Star Cable asserts that its cable system is subject to effective competition, and therefore its cable programming service rate is not subject to rate  Y($-regulation, because it serves fewer than 30 percent of the households (i.e., occupied housing"($0*0*0*%"  Y-units)z5= Yy<ԍ #Xw PE37XP#As the Commission noted recently, "we presume that Congress did not intend 'households' to have a different meaning than in the 1990 Census that would include vacant  YK-units." Third Order on Reconsideration, in MM Docket Nos. 92266 and 92262, 9 FCC  Y4-Rcd 4316, 4324 (1994) (Third Recon. Order). The term "household" is defined by the  Y-Census Bureau to include only occupied housing units. See Bureau of the Census, Dept. of Commerce, 1990 Census of Population, CP11B, Appendix B at B8. within its franchise area, the Township of Nelson.H 5= Y<ԍ #Xw PE37XP#The Communications Act of 1934, as amended (Communications Act of 1934  623 (a)(2), 47 U.S.C.  543 (a)(2)) and the Commission's Rules (47 C.F.R.  76.905 (a)) provide that only rates of cable systems that are not subject to effective competition may be regulated. One of the bases on which a cable system is deemed subject to effective competition is if fewer than 30 percent of the households in the system's franchise area subscribe to the system's cable service. The Communications Act of 1934, (Communications Act of 1934  623 (a)(2), 47 U.S.C.  543 (a)(2)) and the Commission's Rules (47 C.F.R.  76.905 (a) and (b)(1)). Specifically, Star Cable claims that in October 1993, it served a total of 259 subscribers, or 27 percent of the 942 households in the Township of Nelson. As supporting documentation, Star Cable submits a copy of the relevant 1990 Census data which shows that there are 942 households in the Township of Nelson. In addition, Star Cable provides a computer printout as of October 1993 with sufficient subscriber information to support its claim that it served 259 households in the franchise area. Finally, Star Cable includes an affidavit by a responsible official certifying the accuracy of the data presented in the motion. x4. In the absence of a demonstration to the contrary, cable systems are presumed not  Y -to be subject to effective competition.f 5= Y<ԍ #Xw PE37XP#47 C.F.R.  76.906.f The cable operator bears the burden of rebutting the   presumption that effective competition does not exist with evidence that effective competition, as defined by Section 76.905 of the Commission's Rules, is present within its  Y -franchise area. 5= YQ<ԍ #Xw PE37XP#Cf. 47 C.F.R.  76.911(b)(1) (setting forth standards governing petitions for reconsideration of local franchising authority's certification). Order, supra. v Relying on this data, Star Cable submitted sufficient evidence demonstrating that, at the time the CPS complaint was filed, its cable system served 259 of the 942 households, or 27 percent of the households, within the Township of Nelson. Thus, we find that Star Cable's system serving the Township of Nelson is subject to effective competition, and we will therefore grant the motion to dismiss the complaint filed against the CPS rate in that franchise area.
